John Kerry's presence in the SENATE (let alone the Presidency) at the same time as his presence (without his objection) in the Hanoi Museum's Hall of Fame (because of his aid and comfort to the enemy) is unconstitutional. A strict reading (actually the only possible interpretation) of the section cited would lead you to conclude that he should have been barred from the Senate by the rest of the Senators when he showed up for his first day of work, regardless of the will of the voters.
Interesting sidebar: without direct election of Senators, this could have been easily done without the hue and cry about subverting "the will of the people."
Interest sidebar II: Why wouldn't an effort to expel him from the Senate once he's defeated for President be successful?

Yeah, a murderer and worse--a traitor. Sounds like a pair of Senators that our enemies would chose to represent them, had they been given the chance. It's no wonder then that such genocidal foreign leaders as diverse as Kim Jong-il, Usama bin Laden, Yassir Arafat, and the leaders of the Janajaweed and the Interahamwe wholeheartedly endorse John F. Kerry.

Then why is John Kerry even a senator? Because in the good-old USA, the Constitution doesn't mean anything anymore. Also because no-one has had the balls to actually hold Kerry legally responsible for his actions - which go WAY beyond free speech. He lied to intentionally damage the war effort - thus betraying "his" country.
The US has sunk to a level that a lying traitor can have a real chance at being elected to the most powerful office in the world, and I am ashamed of the fact that American voters are stupid enough to possibly put him there.
