This is an update on my previous post. Thank You to all that replied and all that prayed without replying. More prayers are needed.

He has a good attorney. He has done all the homework that is possible.

Today he had a MD testify to her opinion that the burns on thier hands weren't from anything the kids did on thier own.

The Ad litum appointed for the kids(which the judge never signed the order to make him official), her attorney & his attorney agreed to further invesitgation, home studies etc. The Judge said NO.

Even though she had no one testify on her behalf, she didn't refute the abuse except to say he's making a big deal out of nothing and the ex wife didn't ask for it the Judge solicited the Grandparents (her parents)asking "I bet you want to see your grandkids". She didn't even know if her parents were staying for the weekend. The Judge granted them visitation for the weekend with her.

Even his attorney now thinks the judge may give them back to her until they can get a jury trial & he can effect how soon they can get one.(6 months or so)

He found a forensic psychiatrist, but the judge won't accept any more testimony until the final hearing.

We tried all the suggestions we were given before. Any more would be wonderful and any additional prayer would be in order.

Money or no money, getting the very best legal representation is in your friend's best interest right now!

I have one suggestion. I am not a legal type, so don't know if this is possible, but get an attorney for the children and let the state pay the bill. The children are entitled to legal representation just like any one else, and if they have no job or income the state pays. Then request the best possible mind available.

An Attorney Ad Litum was appointed. My Friends Attorney actually indicated that the Ad Litum was very good.

What happened was that the judge never signed an order to legally allow him to investigate the case. Then the Judge ordered that the Ad Litum could not speak to my friend of his ex-wife until the Ad Litum had spoken to all the extenuating witnesses. Which the ex conveniently never provided a list. The Ad litum couldn't even tell my friend or his attorney that he never got the signed order because of the gag order the judge put on him.

My friend found out today (the day of the hearing) what happened when a forensic psychologist who he was just able to contract last night(therefore she would qualify as one of those "witnesses)was advised by the Ad Litum of the situation.

Adding to the strangeness of the situation with the judge not being willing to give the extension on the recommendation of ALL 3 attorneys.
