Lawyers for the DNC and Kerry-Edwards sent this letter to television station managers, claiming the Swift Boat Veterans For Truth ad is "false" and "libelous." Click here for the full letter (can't be pasted into Free Republic window).
Action Alert!
false and libelous??
how come they haven't complained about moore's movie Farenheit 9-11 yet then?????????
Kerry is trying a very weak dodge on this one. His claiming that since these men weren't on the same boat as he they do not know him is specious at best. Its like saying "Because you weren't in my squad, but only in the same platoon, you have no clue as to who I am." BS!!! Most people know just about everyone in their company, and definitely everyone on their platoon. Further, he claims that boats only 50 yards away wouldn't know what was going on. Bullets travel alot farther than 50 yards, and so does the sound of gunfire.
It is beginning to sound like Kerry still weilds some authority over his old crew. They are the only ones saying that Kerry's version is correct. Everyone else that was in the AO says it is a load of crap. Two hundred plus versus a dozen... I would believe the larger group who has no stake in telling the truth.
But that is just me.
Kerry is a "public figure", meaning there has to be actual malice to sue for defamation I believe.
That's nearly impossible, since no one can establish who is telling the truth, Kerry or the Swift Vets.
It's he said/they said.
No libel, no slander, no defamation under the law.
Kerry is trying to destroy the First Amendment and free speech in this country. He is dangerous.
TOTAL BS, wrapped in legal words without any validity.
IF Kerry really wants the truth out, then why doesn't he sign the Form 180 to release the military records that he doesn't want anyone to see?
The Kerry lawyers' address is at the bottom of their gangsterish letter. Write them and ask.
Also tell them to make it widely known which, if any, stations refuse to air the ad.
If my memory serves, two of them out of twelve were on the boat and the rest were not.
He saved the life of one of them, and that would lead me to believe that person would not take a realistic view of the rest of Kerry's character.
That leaves only one person who might be considered an impartial witness.
D
IIRC, the men who served on Kerry's boat served on that exact boat before and after him. Just because he left early doesn't men his crew did.
The Kerry Edwards lawyer, Marc Elias, also represented Robert Torricelli. Nice clients.
John McLame must be proud.
WHAT A HUGE PILE OF UNMITIGATED HORSE BISCUITS!
Let him release all his documents from the Navy files!
PROVE IT, HORSE FACE!
None of the men in the ad CLAIMED to have served ON HIS BOATS. There were a variety of ways to have served with him in the same command at the same time.
Let all the officials who pulled stringes for him testify under oath!
Idiots.
Duplicitous, Machiavellian, idiot, arrogant, treasonous, globalist farces from hell.
God have mercy on their souls but still remove them ASAP from the public stage!
John Edwards: "If you have any question about what John Kerry is made of, just spend 3 minutes with the men who served with him."
Al French: "I served with John Kerry."
Bob Elder: "I served with John Kerry."
George Elliott: "John Kerry has not been honest about what happened in Vietnam."
Al French: "He is lying about his record."
Louis Letson: "I know John Kerry is lying about his first Purple Heart because I treated him for that injury."
Van O'Dell: "John Kerry lied to get his bronze star ... I know, I was there, I saw what happened."
Jack Chenoweth: "His account of what happened and what actually happened are the difference between night and day."
Admiral Hoffman: "John Kerry has not been honest."
Adrian Lonsdale: "And he lacks the capacity to lead."
Larry Thurlow: "When the chips were down, you could not count on John Kerry."
Bob Elder: "John Kerry is no war hero."
Grant Hibbard: "He betrayed all his shipmates ... he lied before the Senate."
Shelton White: "John Kerry betrayed the men and women he served with in Vietnam."
Joe Ponder: "He dishonored his country ... he most certainly did."
Bob Hildreth: "I served with John Kerry ...
Bob Hildreth (off-camera): John Kerry cannot be trusted."
Announcer: "Swift Boat Veterans for Truth is responsible for the content of this advertisement."
Long letter. And here I used to think the best antidote to inaccuracy and scurrilous rumors is truth? One would think the Kerry/Edwards campaign would want to bring out its version of events and let the public decide who is telling the truth. Instead, they file a lawsuit to stifle a potentially damaging ad from being aired. Silly me.

The DNC letter's claims are "nuanced." The Swift Boat Vets didn't claim to be "shipmates" so the statement that none of them served on Kerry's boat is bogus. The SBV's said they were serving in Swift Boats at the same time Kerry was. They don't dispute that the doctor didn't treat Kerry, bandaide and a splash of iodine, but rather that some other doctor signed the form. And so it goes.
There is obviously a lot of interest being shown.
The Kerry lawyer who wrote this silly letter can be emailed at MElias@perkinscoie.com . Let him know what you think, but please be polite.
True, Falwell lost against Flynt.
Or just give them a call at
