They aren't threatening to sue the Swift boat Vets, they are threatening to sue the stations that carry the ad. It much easier to demand censorship and get compliance from the liberal media. What needs to be done is for the swift boat vets to issue letters threatening to sue if the stations refuse their ad.

It's even more devious than that. They are merely playing a delaying card, because these spots can't be shown after Sept 3rd, the new 60 day window.

They don't have to win the case, just drag it out.
