Wasn't a DA issue, OJ was given jury nullification. It was one of the best DNA cases ever. He even fled with a beard and $10,000 dollars.

Juries in LA are just fine, thank you. It's just that OJ's jury was almost exclusively black and they were not going to convict OJ ... a high profile black man. Case in point is when the couple whose dogs mauled that lesbian to death in SF got their trial in Los Angeles ... the Los Angeles convicted their butts like they should have been. When they got up to soppy San Francisco, the verdict was overturned! So don't tell me LA juries don't convict ... they do.

yeah well I believe she swore under oath that she hadnt. Add to that the possibility that she wrote a text message to the effect that she would go after him for money. She will be prosecuted for perjury.

The real problem is that we have two people telling a different story and one has to be a liar. If she is the liar, it wasn't rape and no crime was committed. Is the promiscuous woman a liar or is the adulterous basketball star? I wasn't there. The jury wasn't there. It is his word against her word and the jury needs to believe her beyond a reasonable doubt. At that point, character matters.

Thank you. It does appear at this very early point to be his word against hers ... and they may well decide this young woman is unstable given that she tried to kill herself (before) and had sex with someone else (after).

But if Kobe's guilt cannot be absolutely proved, he should be declared not guilty. Colorado has the toughest rape laws with mandatory sentences.

If there is credible evidence that she bragged about having sex with him (rape) at a party sometime afterwards, then her credibility will be severely undermined.

I'll bet this ruling will be the end to this case. She will drop the charges. Then he ought to sue the heck out of her.

If Bryant's accuser had diminished capacity which prevented her from consenting to sex, then shouldn't the prosecutor be pursuing charges against any other men the accuser had sex with during the same period? I don't think anyone will be making an argument of diminished capacity for the accuser.

You use the terms "normal" and "abnormal" for describing behavior. Reasonable people, which is what jurors are presumed to be, expect people to react and behave "normally" to events. The accuser's "abnormal" behavior, having consensual sex so soon after allegedly being raped, will likely require a compelling explanation in order to avoid creating doubt in at least some jurors' minds. The issue is will her "abnormal" behavior create sufficient doubt to cause jurors to conclude Bryant is not guilty of rape.

Well, I happened to have read the actual order and it does not establish that. I don't intend to argue with normally reasonable freepers who toss all rationality and logic out the window when it comes to this case. But I thank you kindly for the ping.

It makes me sick and also conjures up memories of news stories such as pets being abducted and used as "training aids" for fighting dogs, etc.

I think about something like that happening to one of my boys and I go homicidal.

It takes a pretty sick SOB (or SOB'ette) to deliberately inflict pain and suffering on a creature that cannot fight back on your level (and meant you no harm in the first place).

And for those of you who might be inclined to cite stories of pit bulls, etc. attacking and mauling children, don't.

Those animals were trained to do that for reasons no responsible pet owner would conceive of. They didn't come out of the "doggie womb" predisposed to do this.

And, for the record, if I saw a dog attacking a human (child or otherwise), I'd cap him in a minute.

If her lawyers pull their heads out of their butts and think, they can use this to show that she was not promiscuous, that she is not a gold digger, and all the other things that Kobe's lawyers are trying to paint her as being.

BTW, regarding going to Kobe's room at night that was part of her job. She was a hotel employee.

However, it can quite easily put reasonable doubt in the mind of a juror.

And, that is the bottom line. Do I think rich, sense-of-entitlement, basketball stars would behave badly with a hotel employee? Yes. Do I think that there are young women out there who look at a rich, sense-of-entitlement, sports star and see dollar signs? Yes.

Its a wash for me, and from what I've heard about this case, I'd have to think if I'm on the jury, I have reasonable doubt.

If her lawyers pull their heads out of their butts and think, they can use this to show that she was not promiscuous, that she is not a gold digger, and all the other things that Kobe's lawyers are trying to paint her as being.

Her "lawyers" are the prosecutors, and they'd better stay away from trying to defend their client's sexual history.

They'd lose, big time.
