It depends on what the meaning of the word "in" is. If the socks were IN the shoes at the time, then technically the papers were IN the shoes, not the socks, the socks functioning at that point as a unit within the footwear. Also, can something really ever be contained IN something else? Isn't it ultimately gravity that attached the papers where they were? And since they were pressing against his leg, couldn't it be said that they were technically IN water, since the human body is composed mainly of fluids?
You may be right. If I were in charge, I would recognize that security breaches like this are more important than winning any election. There is NO DEFENSE for Berger. If he gets off, then our priorities are so far off base the Founding Fathers' bones should well be spinning.

I hope what you say is true. But why was Kerry in the dark about it all? If an investigation has been ongoing, knowing that Washington is a town of whispers, you can't tell me that Clinton and all his cronies knew all about it and still Kerry is bragging about Burglar being his #1 national security advisor.

Ex-Presidents exercise some control over the records generated by their administrations for some period of time ( maybe five years). I believe that Clinton has selected Bruce Lindsey to act as his representative in handling these papers. The Bush administration has to agree to any release of such papers. At least one article has claimed that the National Archives contacted Lindsey to report the unlawful taking of documents by Berger.

Yep, conjecture. I know of no grand jury but I also have seen nothing to suggest that there is no grand jury. If all of the people of interest are Democrats it would not surprise me to find that the existence of such a grand jury has escaped the attention of the media.
It would be even more incriminating if there are no calls listed during those times.

First one has to believe what Kerry has said. He is a Democrat, after all.
Secondly, political power seldom comes in a pure form. Deals are made, alliances are formed, and freedom of action is surrendered in exchange for action or inaction from others.
If Kerry had full freedom of action and failed to learn of the recent troubles of Berger, then he is an incompetent fool.
Perhaps Kerry has traded away some of his power as the price for support from others. That price may include selecting certain people for certain posts. Kerry may not have been aware that he was opening himself up to damage by "accepting" Berger. Once again, Kerry seems to be an incompetent fool.
Kerry is a man who "earned" three Purple Heart awards without apparently breaking a bone, losing a pint of blood, or spending a night in a hospital. He was able to use these awards as the basis for leaving VietNam eight months early.
Such a man has no choice but to surround himself with others with similar ethical standards. It should be no surprise to find that his top advisors are under suspicion of having committed crimes. Berger probably won't be the last.
Assuming that Berger was to have become the National Security Advisor to Kerry, what better way would there be for the Klintons to continue selling out America.

Pressure should be placed on the media to keep this story afloat. At least some of the outlets are searching for anthing to avoid or trivialize this scandal. It is far bigger than Watergate.
