There is ample probable cause to suspect Berger has committed a crime. His motivation is unclear, and irrelevant. There are several million individuals with security clearances, but probably no more than 50,000 or so (just my own estimate) with anything as high as Berger has held. Every single one of them would be immediately charged if they were discovered hiding documents in their clothing while existing from a high security enclosured.

Legal justice, and prosecutorial integrity require that Berger be charged, and get his day in court. It is not fair to prosecute him via the national press. Neither is it ethical to allow him to skate without being charged, by virtue of "who he is".

HE MUST BE CHARGED, tried, and either convicted or acquited.

This is a critical test for Ashcroft's Justice Department. If they will not defined the integrity of classified government data, then nothing will remain secure.
