WSJ: Berger Took Secret 9/11 Docs on Five Occasions

Kerry campaign advisor Sandy Berger removed secret terrorism documents from a 9/11 Commission reading room on no fewer than five occasions, his lawyer Lanny Breuer admitted late Monday night.

Breuer told the Wall Street Journal that his client, who served previously as the Clinton administration's National Security Advisor, inadvertently removed several copies of an after-action report on the foiled 1999 Millennium bomb plot during two separate visits to the top secret facility.

Breuer said also that Berger had deliberately removed handwritten notes that he had taken during three additional visits to the Archives last fall to review classified documents.

Mr. Breuer said removing those notes was a violation of National Archives policy, and that Mr. Berger regretted the action. "He knew it was a technical violation, and he admits that it was an error in judgment."

But according to New York civil rights lawyer Ron Kuby, Berger's decision to remove his notes wasn't just a "technical violation."

"You're not permitted to remove anything from that room - period," he said Tuesday morning. "And that means even your notes. If you're taking notes about classified information, those notes are now classified. They're placed in a secure area. You can have access to them only while being viewed by a security officer. Nothing gets removed."

Even if Berger had only removed his personal notes on classified material, it would still be a crime, said Kuby, who learned about classified reading room procedures during his own involvement in the trial of the 1993 World Trade Center bombers.

thanks. that's a good play politically, hopefully Rove is awake - regardless of whether the criminal allegation goes anywhere, if we can say he removed/destroyed documents and link both the destruction of some and perhaps the leaking of others to the 9-11 commission for partisan purposes, that would be a good spin on this story.

At least until Pat Roberts excuses all of it as an accident.

This is preposterous, my client did nothing wrong, there is a plausible, perfectly reasonable explanation for all of this, in the due sourse of time, it will come out. The slander that has been directed at my client is nothing short of ridiculous and totally out of bounds. How would you like it if some came to you and said that you couldn't tuck your shirt in and accidentally have top secret memos get tucked in as well. It's simply ridiculous, and is obviously some sort of attack on my client's weight.

Berger is guily of perjury for his sworn 9/11 commission testimony when he claimed the Clinton Admin. thwarted the millenium bombing and the NY "Day of Terror" landmark bombings. Berger knows full well what is allowed and not allowed.

Clinton had Gorelick, Benvenista and others put on the 9-11 panel to protect him.

Clinton has to send Berger to retrieve certain other documents and 'inadvertantly' lose at least 2 originals.

Makes on wonder how many classified documents got shredded during the latter Clinton days.

Yup, it was buried in both my local papers too. Sounds like it was the same article.

The front page of both papers continued on about the horror of Arnold's "girlymen" comment, as did the editorials of both papers.

I didn't see anything in the print edition of the WSJ today, either.

It's already dead, dead, dead.

HOLY CRAP.......this just gets better and better!

I dunno about that. Because....more than likely nothing is going to happen to him. And more than likely nobody is going to vigorously "go after" him, and the Clinton Administration.

It's all just too easy...If you make the trail a paperwork snowstorm...and do a little shredding here, and "oops, we lost that" there. They've got away with it, and will continue to get away with it.

It just keeps getting worse, IMO.
