In my job, I absolutely, 100%, guarenteed, without a doubt, and with no possibility of failure assure you that if I had been caught taking home highly classified documents AFTER STUFFING THEM IN MY PANTS to sneak them out, there would be no decision as to whether or not I'd be prosecuted.
That would also include any notes made. Any notes I made from classified documents were themselves considered classified.

Sandy Burglar SHOULD be charged with a crime because he DID commit a crime. He admitted it. He stated he was "sloppy". What he meant was he was so sloppy and stupid that he got caught. Those documents in the National Archives belong to you and me. I want them back.

I expect this to be the standard story in all print media tommorrow, if it gets any play at all.
The spin started quickly. I heard one of our esteemed reporters ask the question But was National Security compromised? The commentary seemed to put forth that since nothing was handed over to a foreign country nothing was wrong.

Absolutely. One sentance, and in some cases, one word, would be all that it takes to turn an 100 page unclassified document into a classified one.
Copying 'a few notes' from a classified document does not declassify the notes. It's the information that is classified, not the paper and ink of the source document.
