WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.

Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.

Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.

"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.

Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.

The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.

When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

The notes are a ruse if you ask me. He wanted to hide something from the commission. What would he need notes for.

The ploy was to just get the docs out of the secure room the commission was using to search through the record. Can't find what isn't there, and you have no way of knowing what you didn't find is missing.

Maybe that is why Max & Terry went off the deep end with their comments today

This Berger revelation basically totally kills any credibility the 911 commission report...which wasn't much, imho.

And Gorelick, Roemer, Ben Veniste and the gang have abetted Berger in his attempt to cover up for the Clinton years. This is so disgusting. The American people deserve better than this. Kerry should give a press conference to explain what influence Berger has had on shaping his foreign policy. Kerry needs to publically fire Berger--Kerry can't have an adviser who obstructed the 9-11 Commission. Kerry is a major danger to this country.

Sandy Berger had to request to see the documents, he would have to give the dates of the memos or documents and they would send him to where they were. I have been to the National Archives and there are camera's everywhere, they have him on camera taking these documents, I guarantee it.

Being a former Nat. Sec Adviser he would have clearance to see them, he would just need a reason, and granted permission from the proper authority

If it wan't requested maybe it was because the Commission didn't know to look for it, or what they'd be looking at. So why snatch the docs? Unless something happened that would suddenly make sense of them. Or unless something else was snatched as well, and these other docs are the cover.

This is BAD! I don't know what the facts are, but until they are fully known, Kerry needs to distance himself from Berger pronto.

Fox is already having multiple orgasms over this story. And isn't it handy that the story provides a perfect distraction from the 9-11 Commission findings?

Who needs this on the threshold of the Democratic Convention?
