WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.

Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.

Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.

"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.

Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.

The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.

When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

Well, well.

This news came at an interesting time, didn't it? This is certainly going to impact the legitimacy the Dems hoped to give the release of the Commission's report on Thursday.

I want names.

I want the names of all that left those documents unprotected. All those that knew about what occured.

WE are supposed to entrust our national security to these people when they cannot even be trusted with these documents?

WHY do this? Gorelick and the media were there to protect the Clintons. What exactly was in those papers that they couldn't even count on those loyal corners to hide?

If Gore was President, there would be no criminal investigation of Berger or any other Democrat scumbag. I can't begin to imagine what the Clintons shredded on their way out the door. So now Berger (and who knows who else) is scurring back like a mouse to pick up the stuff they forgot. Unbelievable.

Any prayer that any of this gets mentioned on Nightline?

The above statement alone is the set up for a "I don't recall" rebuttal if fully probed for an answer.

Agree. Suppression of these documents must be very important to someone.
I'm amazed that Berger may have actually thought he could get away with this.

The fact of the matter is, The Clinton Administration was never going to make any controversial or committed stand against the clear and present danger we were facing from the Terrorists. Clinton handled the threat posed by Al-Qaeda the same way he handled the he did "John Doe #2" that was taken into custody shortly after the OKC Bombing....... He made the politically opportunistic choice, and to hell with the security of the United States

At the level that Sandy was looking at in the files I doubt that the documents were only CONFIDENTIAL. More likely they were TOP SECRET/Sensitive Compartmental Information with multiple caveats after the TS/SCI to restrict even more who could see or handle them.

The boy could be in some very serious trouble. Deal time?
