(Rochester-AP) -- A teenager has told police he aimed a shotgun at the back of his mother's head as she lay on the living-room couch watching television. Eighteen-year-old Nathan DeWispelaere said told police he stood with the gun about two feet from his mother's head thinking for a few minutes before shooting her in May. DeWispelaer was indicted last month. He has pleaded innocent to second-degree murder in the killing of his mother, Lizabeth at their home in Sparta in rural western New York. DeWispelaer told police his mother had harangued him about using drugs after she found his prescribed Ritalin crushed into a powder he planned to snort. DeWispelaer's elder brother died of a drug overdose last year. The two-page statement to police was made available by the prosecutor's office today after the Rochester Democrat and Chronicle filed a lawsuit to obtain transcripts of a preliminary hearing had been closed to the public.

Sounds like the kid may have watched someone (his brother) snort something to even know about crushing a pill to enhance the effect?

I assume this is New York State. The only way to get a 1st degree murder charge is to kill a police officer, officer of the court, or to kill someone in the commision of another crime. Any other premeditated murder is 2nd degree at most -- no death sentence available.

This is common knowledge. He didn't have to watch someone.

My statement was the "world acording to G.Mason", which like my stand on many things I hold dear, are antiquated, and quite meaningless to most. ;)
She didn't really say anything at first, the statement read. She just started in with the questioning. She wanted to know what it was and whose it was and where I got it from. She is really sensitive about drugs because of what happened with JJ (DeWispelaere's older brother, John J. DeWispelaere, who died unexpectedly in 2003). JJ died of an overdose of drugs and alcohol. We argued about the paper with the Ritalin
She said she was having the paper and powder tested and me drug-tested. After the lecture/argument was done, Mom went in and laid on the couch and was watching TV.
I went into my room. I was very upset. I was very scared that Mom would be disappointed in me. I knew Mom would not let this just drop. I knew she would now go out and question all my friends. I didn't want her causing trouble with my friends and their parents. Mom is a kind of rabble-rouser. She gets onto something and doesn't let it go. I didn't want Mom blowing this whole thing out of proportion.
She wouldn't have let me out of her sight from then on. She would not let this go. She probably wouldn't even let me go to college because she wouldn't want me into the drugs.
DeWispelaere then got his shotgun, according to the statement. As I was standing there, I don't think that Mom knew I was there. I (pulled) the trigger and Mom was shot in the top of her head.
This was pure pre-meditated, cold-blooded murder.
Sounds like the DA was inept, if you ask me.
Not unless it was poorly prescribed. Many times lack of impulse control is one of the reasons for these drugs.
He was having trouble working on his high school senior paper about doctor-assisted suicide. He has attention deficit disorder and takes the drug Ritalin to keep me focused.
There are things since the time that you were school. you know what there called don't you? how about medical breakthroughs. technology has helped us progress in the field of medicine. thats why we can cure more diesas and even diagnose new ones.
