2nd degree murder? I think not. I assume this is New York State. The only way to get a 1st degree murder charge is to kill a police officer, officer of the court, or to kill someone in the commision of another crime. Any other premeditated murder is 2nd degree at most -- no death sentence available.

You are, no doubt, correct.
My statement was the "world acording to G.Mason", which like my stand on many things I hold dear, are antiquated, and quite meaningless to most. ;)
