ST. CATHARINES, Ontario -- It wasn't the prospect of fighting in a war that drove Brandon Hughey to desert the Army and take refuge in the basement of a Canadian home, Hughey says. It was the prospect of fighting this war.
"From a soldier's perspective, if I was going to fall in combat, I'd want the peace of mind that I was doing it for the right reasons and that it would cause some good," said the 19-year-old, who had been stationed in Fort Hood, Texas.
Hughey is one of three known U.S. soldiers who have fled to Canada. His attorney has applied for refugee status for him.

This I would call a 'tragically stupid career move'. Mistake #1.
Although he faces prosecution that could lead to a jail term, a dishonorable discharge or both, Hughey said he is not a criminal.
Tell it to the judge. Mistake #2

Not only that, but this jerk signed up *last November* for the military. It's kind of dopey to complain about going to Iraq, when he signed up for the military after we had already gone to war there.

why did he not go through the process of consciencious objector? There is a process for this which does not required deserting.
I hope they have his name on the boarder patrol watch lists.
Now if we can get him to stay in Canada or better yet.. move to France it would be "a good thing".

I doubt it matters, with his style of commitment he'll drop out of school, quit his jobs, and ruin his own life. Because he is a stupid enough person to join the Army without considering there may be parts of it he doesn't like. Who would he like to go to war with, maybe it can be arranged, he can be an Army of One.
From what my son tells me, a dishonorable discharge is the equivalent of a felony. (My son has a medical from the Army, his feet are so flat they are almost convex)
If this is true about a dishonorable discharge, then no wonder he's trying to avoid the consequences.

Nope, by UCMJ definition conscientious objector status requires oppostiion to all wars, he still doesn't get to pick and choose.
