Member of Civilian Border Patrol Convicted on Weapons Charge; Mistrial on Assault
HEBBRONVILLE, Texas June 17, 2004 A member of a self-styled border patrol group who was accused of pistol-whipping an illegal immigrant was found guilty of gun possession. But the jury deadlocked on the assault charge.
Casey Nethercott, a 37-year-old member of Ranch Rescue, could get up to 20 years in prison on the weapons offense. A new trial on the assault charge was set for July 27 after the hung jury Wednesday.
Nethercott was accused of assaulting Edwin Alfredo Mancia Gonzales, 26, last year while Nethercott and other members of the armed group were patrolling a ranch in the South Texas town of Hebbronville.
Ranch owner Joe Sutton said he had asked for the group's help because he did not want illegal immigrants and drug smugglers on his land. Mancia was trespassing on Sutton's land to get past a border checkpoint.
Nethercott, Ranch Rescue and the Suttons are also being sued by immigrants' rights groups in a case expected to be heard in August.
Ranch Rescue's stated mission is defending private property. It has seized drugs and rounded up illegal immigrants along the nation's border with Mexico.

"Gun possession" in Texas? Hell, everybody in Texas has a gun. Heck, they got 2, 3 or 4 guns. All their friends have guns too! What are they going to do? Put everyone in jail?
It's possible he is a convicted felon or under a restraining order.
If the land was posted and the alien was told to leave and didn't, he could have been shot.

Under our current laws, he is a convicted felon and has lost the right to possess a firearm.

Mancia testified he was hit on the right side of the head, but Jacobson asked him about a police report made the day after the reported assault indicating he was hit on the left side.
"I don't think (the statement) was right because I told the lady that it was on the right side," Mancia said of the clerk who translated his statement into English.
Mancia testified he didn't know how much time went by before he was hit. Reminded of a deposition taken April 14, he said Nethercott hit him four minutes after he was caught.
Mancia initially testified he had a lump on his head for two weeks after the incident. Reminded of the same deposition, he changed his answer to one day.
"The swelling went away in one day, but the redness didn't go away in one day," Mancia testified.
Alberto Reyna, a Border Patrol agent who took a statement from Mancia a few hours after the alleged assault, said he didn't notice a lump.
"It was a bruise," Reyna testified.
But Texas Ranger Doyle Holdridge, who interviewed Mancia several hours after Reyna, said there was swelling.
"There was a knot half the size of my fist on the back of his head," Holdridge testified.
He said he wasn't aware that Ranch Rescue was in South Texas until this case and described it as "a disaster looking for a place to happen."
Before prosecutors rested their case Tuesday, a video was shown to the jury of a taped interview of Nethercott on Fox News' "The O'Reilly Factor."
Nethercott said he participated in the patrol because Sutton was at his "wits end" over trespassers. He said the immigrants weren't assaulted, but rather given food, water and a blanket.
"It's lies made up by the police department that investigated me," Nethercott said of the charges against him.
If convicted, Nethercott, of Douglas, Ariz., could face up to life in prison. He was convicted previously in California for aggravated assault.
