TAHLEQUAH, Okla., June 16 (UPI) -- The Cherokee Nation Tribal Council has voted in Oklahoma to ban same-sex marriages after a lesbian couple attempted to file a marriage certificate.
Kathy Reynolds and partner Dawn McKinley said they would continue their fight through the courts after being rebuffed by the tribal court Tuesday, the Oklahoman reported.
"I'm feeling frustrated, disappointed," said Reynolds.
The tribal council voted 15-0 Monday night to enact a ban against same-sex marriages.
The women were married May 18 in Tulsa and it was the second time they had been turned away when they tried to file the tribal marriage papers with the Cherokee Nation.
The state of Oklahoma also bans same-sex marriages and does not recognize them from other states.
Todd Hembree, the tribal attorney, said Cherokee law always banned same-sex marriages, but the new law "cleared up any ambiguity, if any ever existed." Another tribal court hearing on the issue is scheduled Friday at Tahlequah.

Since they are a sovereign nation can the Supreme Court use this rejection when ruling? After all, the Supremes are using foreign law now instead of the Constitution.
The ACLU can't touch them, either, right?

Absolutely not. I believe you'll find that reservation lands are soveriegn territory held by the tribes. The ACLU hasn't a leg to stand on in Cherokee law.

Also in the news, the Council voted 15-0 to establish that "grass is green" and the "sky is blue."
"We never expected to have to state these things," a Council spokesman was quoted as saying, "but the way these stupid white people are driving their society into the dirt, I guess we have to publicly state the obvious to avoid getting sucked down with them!"
