It is still legal to say the pledge with "Under God". The anchor was speculating the maybe the problem is Newdow did not have custody of his daughter when he filed. The court just totally threw out the case.
We are still a nation "under God", rather than one without one.

Gutless. This settles nothing. In my opinion, they just couldn't rule because they didn't want to look like fools, yet to be consistent with past rulings, they would have had to rule "Under God" unconsitutional. This was the chicken way out.

I'll bet the technicality was that Newdow didn't have
standing in the case as he didn't - and still doesn't, have legal custody of his daughter.
In any case it's one for the good guys!

They are saying that he lacked the legal standing to bring the case in the first place, due to not having custody of his daughter.
