Sen. Edward Kennedy Loses Bid to Get Bill Pryor off Federal Bench

ATLANTA (AP) - Sen. Edward Kennedy lost a legal challenge to President Bush's appointment of former Alabama Attorney General Bill Pryor to a federal appeals judgeship. Pryor's appointment has been vigorously opposed by Democratic senators who have objected to his past comments and writings on abortion and homosexuality. After the Senate failed to confirm Pryor's appointment, Bush installed him on the 11th U.S. Circuit of Appeals on Feb. 20 as a "recess appointment," which does not require Senate confirmation.
In a challenge filed with the 11th Court, Kennedy argued that the appointment was unconstitutional because the Senate was merely adjourned, not on recess.
But the appeals court said Kennedy missed an April 28 deadline for filing his challenge. The court did not comment on the constitutionality of Pryor's appointment to the bench.
Kennedy spokesman David Smith said Bush misused the power to appoint a nominee, disregarding the constitutional separation of powers.
"The power was abused here to avoid Senate scrutiny," he said.
So scrutinize and hold a vote, instead of holding them in committee till the end of time.

When in the world is Ted Kennedy going to retire? He must be at least 80. He thinks he is king. Sooner or later he will have to retire and that will be the day that America gets back on its feet.
Just who abused power Senator Kennedy? I think the senate is abusing IT'S power of advise and consent, but then, abuse is not new to you is it senator?
It seems that every year, Kennedy plunges to new depths. In nearly every judicial confirmation, he tries to dredge up the past to find some kind of imperfection in a nominee. The Pryor appointment is only a recess appointment, therefore temporary. Yet Kennedy accelerates into a lawsuit. Well, thanks to the ruling, he's all wet. Of course, word has it that Kennedy is always well-watered, even on dry ground. In the year 2004, Pryor will no longer be on the bench and his confirmation fight will be water under the bridge. I just look forward to the day that Kennedy's career has run its course.
All those years of abusing drink and food should catch up with him soon.
