ATF Agents Arrest 14 in Multistate Operation

RENO, Nev., May 21 /PRNewswire/ -- John A. Torres, Special Agent In Charge of the San Francisco Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), announced today that ATF agents in California, Nevada, Idaho, Utah and Washington State participated in the arrests of 14 people after a federal grand jury returned indictments charging them with federal firearms violations. All of the defendants were charged with dealing firearms without a license, illegal sales of firearms, possession of unregistered firearms, and possession of firearms by prohibited persons. One of those arrested, Laquan J. Abdulrahim of East Palo Alto, Calif., was also charged with possession of body armor by a violent felon, the first time a defendant in Nevada has been charged with this federal violation. This charge alone carries a maximum penalty of three years in federal prison.
Dubbed "Operation Over The Line," the year-long investigation into the illegal purchasing and trafficking of firearms ultimately led agents to individuals in three other states. During the course of the investigation, more than 400 firearms were seized with dozens more to be retrieved in the near future. ATF undercover agents purchased approximately 30-40 firearms from various individuals, including some that were illegal. The agents purchased firearms from federally licensed firearms dealers (FFLs) as well as unlicensed dealers.
"Although some of these transactions took place at various gunshows in Nevada, a minority group of people chose to use gunshows as a conduit to conduct their illegal activities," Torres said. "The gun shows were not the target of our investigation."
In addition to the arrest warrants, agents served a federal search warrant at the residence and business of Larry B. Reimer, of Pahrump, Nev. Reimer was arrested pursuant to the grand jury indictments. Reimer, a licensed firearms dealer, was charged with the illegal transfer of a semiautomatic weapon and the illegal sale of a firearm. These charges carry a maximum penalty of five years each in federal prison.
Among the items recovered at another search warrant location in Nevada were a number of firearms, including machine guns, as well as explosive materials.
Torres praised the Reno Police Department, Washoe County Sheriff's Department, the Nevada Highway Patrol, California Highway Patrol, the West Sacramento Police Department and the California Department of Justice for assisting ATF in this investigation.
"ATF will continue to reduce illicit firearms trafficking by investigating individuals who provide firearms to prohibited persons, who deal without a license, and who sell firearms illegally. Working with our state and local partners toward this endeavor will keep firearms out of the hands of criminals," Torres said.

-- Lamar Reid, 24, of East Palo Alto, Calif., one count possession of firearm while under domestic violence restraining order.
-- Larry B. Reimer, 41, of Pahrump, Nev., one count illegal transfer of semiautomatic assault weapon, one count illegal sale of a firearm.
-- Kurt Wilson, 52, of Coeur d'Alene, Idaho, four counts unlawful dealing at out-of-state gun shows, three counts unlawful selling of a firearm to out of state resident, one count possession of a machine gun. Also charged in Idaho with possession of unregistered firearm.
-- Angie Wilson, 53, of Coeur d'Alene, Idaho, three counts possession of unregistered firearm, charged in Idaho.
U.S. Attorney Daniel Bogden of Nevada says nine of the suspects were arrested after search warrants were served today while five others already were in custody as part of the ongoing investigation.
They've been indicted by federal grand juries in Nevada and Idaho. The indictments, some dating to February, were unsealed today.
John Torres is the ATF special agent in San Francisco in charge of the investigation. He says agents purchased nearly 40 firearms using different Reno gun shows as the hub of activity. The agents purchased guns over the past year at about ten gun shows, one in Las Vegas and the rest in Reno, including at least one large events held at the Reno Hilton hotel-casino.
The guns include eight machine guns, ten hand guns and 15 long guns.

Our Federal Public Defenders in Idaho have discovered a couple very important facts the ATF "sortta forgot" about.
1) They (the ATF agents) purposely mislead the Judge that issued the Search Warrant.
The used a fraudulent affidavit from a known criminal AND ancient innuendo's about Survival Enterprises ("he said - she said - I think they said") to obviously confuse the issuing authority of the Search Warrant (the Judge). Therefore, there was NO "probable cause" for the search warrant the ATF used.
Either that, or the Judge issued the search warrant in flagrant disregard for the law. We'll see come Oct 1, when the Pretrial Hearing is here in Idaho.
2) According to US Law, the Search Warrant was supposed to be performed DURING GENERAL BUSINESS HOURS!
As we were in Reno at the time they broke in, AND we had a sign posted on the door stating that, AND our business hours are from 10am to 5 pm, AND they broke in around 8 pm - the ATF broke the law!
This fact, by itself, is grounds for a dismissal of the case and full suppression of the evidence.
My lawyer so filed that on Sept 3rd. (I will have a copy of the filing posted here soon).
Asset Seizures by the Feds
(In the Reno case)
As you know, the Feds seized over $60,000 worth of highly collectable firearms from us at the Reno Gun Show and another $50,000 worth of firearms from us here in Coeur d'Alene. When I asked my Reno lawyer what about getting those guns back in the Reno area, I was told "we don't do civil actions. You'll have to get another lawyer for that. Sorry, but that'll cost you lots of $$$!".
A month ago I received a notice from the Feds claiming that they wanted me to "abandon" the guns taken in Reno. I filed the proper form to refuse that and to get my property back. Everyone was so very sorry, but I would have to spend many thousands of $$$ (which we don't have) just to get MY PROPERTY back.
I started to do some research about "Asset Forfeiture": the highly illegal and massively unethical way the Government has of bilking it's citizens out of OUR PROPERTY. I found a well informed website at http://www.fear.org Through this site, I discovered that in the year 2000, due to the corrupt manner our Government was doing asset seizures, the whole law had been revamped. (Civil Asset Forfeiture Reform Act of 2000)
A little known fact (which the Feds will NOT tell anyone) is that if you qualify for a Public Defender to protect your rights in a criminal case, you also qualify to be assigned a defender to protect your rights and GET YOUR SEIZED ASSETS BACK!
I just discovered this US law this week, and will be notifying the Nevada Court next week that I want a lawyer!

My Public Defender here discovered that the ATF illegally took all our firearms during the search warrant. They had the right to ONLY take the three that they are charging us with. Next week (after Labor Day) he will be filing a demand for return of property.

A nice little addendum to the Civil Asset Forfeiture Reform Act of 2000. Seems that, if the court DOES give me back my firearms the Feds stole, and if anything is damaged, I can sue the agent/s responsible for the damage for up to $50,000!
Considering that when the Feds stole all my firearms, they REFUSED to put any of them either back in their boxes or even into soft cases, I'm figuring that I will have THREE lawsuits to file: one against ATF Agent Watkins in Reno and two more hear in Idaho against ATF agents Jason Force and Susan Nelson.
