Thanks for that information, FV. I'll be straightforward and say that I'm conflicted here. THIS decision was about whether or not to accept jurisdiction of the expedited appeal from the appellate court, not a ruling on the constitutionality of Terri's Law. I honestly expected there to be some disagreement among the justices as to whether this case fit the required (legal) definition of "great public importance" (the appellate courts rarely certify directly, and the Florida Supreme Court accepts those infrequently). To be honest, I'm a little surprised the Florida Supreme Court actually accepted this one.
But, honestly, that's not my conflict. I know that Governor Bush (or his attorney) argued vigorously in opposition to the appellate court's motion to expedite, and Michael Schiavo filed a very short response in support of it. And there's my conflict:
If Terri's Law if defensible and legally justified (as Governor Bush and his attorney have said, time and again), why in the world wouldn't they want it to be heard by the Florida Supreme Court as soon as possible? Why would they want to delay this LASTING and PERMANENT protection for Terri's life (and the legal affirmation of it) for one day more than necessary?
Honest to goodness, I feel that so many of the actions that have been taken by Governor Bush thusfar in this case have been (it nearly kills me to say this) nothing but 'delay' tactics to prevent the case from being heard. The part of the lawsuit that claimed that the jurisdiction and legal service were "illegal" is just one example of a claim that was, in my opinion, a no-brainer doomed to failure, and honestly didn't seem like anything but a weak excuse to delay.
I'll say it again, and then put on my flame-proof suit...if Terri's Law is solid and can withstand the constitutional test, then why are we pussyfooting around about it? Why aren't we (well, Governor Bush) pushing for the earliest hearing before the Florida Supreme Court that we (he) can get. It was a given that Terri's Law would get bounced in the Florida 6th Judicial Circuit Court, and it wouldn't have mattered if it was Judge Baird or Judge Judy who got assigned the case. Considering the history of this case in the 2nd District Court of Appeals, how could we expect to win there? And why would we want to add the 2nd District Court of Appeals' log to the fire? Obviously, we'd have had to face the Florida Supreme Court sooner or later, and why the heck not sooner?
Things aren't (I'm talking results, not optimistic reports) going well in the guardianship side of the house. They never have. The fact is that Terri is alive today because of Terri's Law, and Terri's Law is what's keeping her alive. If it's right, it will be upheld, and the sooner the better.

What is with this 'sudden hearing' thing? I didn't think Judge Greer or Baird or Demers (whatever), let's just say the rest of the apparently corrupt creeps, EVER allowed anything that might benefit Terri or those who love her, to go forward with some speed. What's up????

Does the Florida Supreme Court have a good reputation for deciding what is and what is not Constitutional? In order to present a complete argument to the Court, should not the defendant have the right to interview potential witnesses in order to obtain all the relevant facts? If Michael Schiavo is not fit to be Terri's guardian, would that not make his suit unwarranted?
