MONDAY COURT DATE SET FOR JUDGE BRONSON TO HEAR MOTIONS FOR DEFAULT JUDGMENT AGAINST DYER, PAGE IN ORLANDO ELECTION FRAUD LAWSUIT
(ORLANDO) On Monday, May 17, 2004, at 11:00 a.m. Orange/Osceola Circuit Judge Theotis Bronson will hear the motions by Mulvaney attorney Frederic B. O'Neal for a default judgment against Buddy Dyer and Ernest Page in the City of Orlando election fraud case.
This hearing is the next step in the effort by Mulvaney to invalidate the result of the March 9, 2004, Mayoral election. If successful, Dyer and Page would be removed from the upcoming trial. Attorney's for Dyer and Page failed to file responses to the Mulvaney lawsuit as ordered by Judge Bronson within the ten (10) day deadline established by the Judge. To date, neither Dyer or Page have responded to the suit as required by Judge Bronson.
Mulvaney attorney O'Neal will also file a motion to "immediately" advance the case to trial. Currently Judge Bronson has set a trial date for July 26, 2004. Florida law requires an "immediate" trial for election contests.
The trial will involve dozens of witnesses who will testify that paid Dyer consultant Ezzie Thomas improperly influenced absentee voters and tampered with absentee ballots in clear violation of Florida law.
Judge Bronson has already denied a motion by Dyer, Page and the City of Orlando Canvassing board to dismiss the lawsuit.
The Monday hearing will be heard in Judge Bronson's courtroom on the 19th floor of the Orange County Courthouse.
