Please sign the petition to have Fl Sen Jim King removed from office pursuant to the requirements detailed on the petition.
We are petitioning Florida Gov. Jeb Bush to suspend Sen James E. Jim King from his senate position to which he was elected. We are also petitioning the Florida Senate to permanently remove Sen King from his office. This request is being made pursuant to the provisions in Article 4, Section 7 of the Florida Constitution. The reasons for suspension and removal from office are malfeasance, misfeasance, incompetence and neglect of duty in office. We are also requesting that the Republican Party of Florida bar Sen. King from any representation of the Republican party.
This request is being made for the following reasons:
1.Malfeasance is defined as Misconduct or wrongdoing, especially by a public official.
Sen. King is guilty of malfeasance for some remarks he has made concerning the situation of Terri Schiavo. It is an unspeakable violation of Sen. Kings oath of office to have commented to Sen. Byrd that Terri Schiavo should die. Our state and national constitutions guarantee the right to life for all. His statement is out of line with the standard of integrity citizens expect of their elected leaders and to qualify it as malfeasance is a great understatement.
2. Misfeasance is defined as Improper and unlawful execution of an act that in itself is lawful and proper. Sen. Kings refusal to allow SB692 to be heard in the Senate is a denial that the current statutes concerning nutrition and hydration are not sufficient to protect all of Floridas citizens including many who are fed by the same means as Terri Schiavo. By not allowing the statutes to be reformed to protect all of Floridas citizens Sen. King is allowing an unlawful execution of the statutes he authored pertaining to end of life care which should not be applied to any person who is in otherwise good health. It is improper to allow a statute to remain as written when it can be used or twisted by a court to authorize the starvation and dehydration of a human being.
3. Neglect of duty is defined as breach of a (legal) duty Sen. King stated that he would not vote for SB692 and that he regrets having voted for Terris Law which allowed Gov. Bush to have her feeding tube reinserted. The article Regret Plagues King after Schiavo vote contains the following quotes which really show King's true position: "The Terri Schiavo vote that I made was probably one of the worst votes that I've ever done," said the Jacksonville Republican and 18-year veteran of the Legislature.
There is "no question" he would not vote that way today, King said, "and if it comes up again I will not do it."
The following quote can be found in this article Changes Proposed In Right-To-Die Laws
``I don't want anything on the floor in that Senate that is going to give platforms to people who want to roll back the hands of time for whatever reason,'' King said. ``As soon as you put something on the floor, as well-intended as it may be, anybody can amend it. Then all of a sudden I'm sitting there facing a bill or bills that can dismantle what I consider to be my legacy.''
Senator King was elected to serve the citizens of the state of Florida and to represent his district. His previous statements indicate that he will vote as he wants regardless of how many phone calls or letters he receives. Sen. Kings decisions affect all Floridians not just those living in his district Sen. Kings legacy has become more important to him than representing the voters in his district and the citizens of the state of Florida and is a monumental neglect of his duty.
Sen King also thwarted efforts last year to require abortion clinics to adhere to the same surgical standards as outpatient clinics, this bill had it been introduced would have provided a greater degree of sanitation for women choosing to use the services of one of these clinics.
For the reasons given above and for others (which do not necessarily fall under the prerequisites for suspension such as supporting adoption by homosexual couples and apologizing for the name of Jesus being mentioned in a prayer but nevertheless indicate that Sen. King does not represent a conservative viewpoint which was implied to prospective voters) the undersigned are requesting an immediate suspension of Sen. James E. Jim King and subsequent removal from office.
Sincerely,
I wish everyone knew how grateful my family is for everything that everyone is doing to help Terri - they are all truly a Blessing and a Gift to Terri from God, because Lord knows we could never do this ourselves.
xxxxx Terri's Brother
