Pinellas judges rules Schiavo law unconstitutional

Circuit Court judge ruled Thursday that the law pushed by Gov. Jeb Bush to keep a severely brain damaged woman alive is unconstitutional. The governor's office filed an immediate appeal.

The ruling by Pinellas Circuit Court Judge W. Douglas Baird ends the first legal fight over the October law, passed just days after Terri Schiavo was disconnected from the feeding and hydration tube which has kept her alive for more than a decade. Her husband Michael had fought a long court battle to carry out what he said were his wife's wishes not to be kept alive artificially but her parents have said there were no such wishes.

The law allowed Bush to order Terri Schiavo's feeding tube reconnected.

Michael Schiavo has waged a long legal battle to disconnect the feeding tube that keeps his wife alive. She was left severely brain damaged more than 13 years ago after her heart stopped beating because of chemical imbalance brought on by an eating disorder.

Michael Schiavo contends his wife never wanted to be kept alive artificially. Her parents, however, doubt she had such wishes and believe her condition could improve with therapy.

Last fall, the Florida Legislature and Bush intervened to keep Terri Schiavo alive after a court had ordered the feeding tube removed, causing Michael Schiavo to sue.

Truly bad news, nick. But, we knew it was coming. I wonder how long Bush can keep this going?

I wish beyond all things that the church would grant this poor girl an annulment.

I heard about this on national(radio)news about a half hour ago but didn't hear the whole thing so I wasn't sure if they were talking about Terri's Law.

Dear God it looks like they're going to get away with killing her.

Baird ruled that the so-called "Terri's Law" is unconstitutional because it violates the Schiavos' right to privacy and because it delegated legislative power to the governor.

I guess it's becoming more and more the wave of the future to equate "privacy" with "murder".

Just received this from Fight4Terri:

Today, Judge Baird ruled that Terri's law is unconstitutional.
Furthering an order for Governor Bush to be enjoined and restrained from exercising any authority with regard to his involvement's in the case.
Judge Baird also ordered Governor Bush be disallowed discovery or deposition in the case.

The Governor's attorney's have already filed an appeal in the appellate court which places all into a temporary stay until heard.

This does not prevent George Felos from asking the Judge to lift the stay and request that Terri's tube be removed.

Of course it's unconstitutional! The Founding Fathers clearly believed that starving a woman to death is a merciful act. It says so in the Constitution, right here in Article mumble-mumble Section mumble-mumble, and anyone who says different is a fascist bigot who can pull my finger!

From what I understand, we have nothing to indicate Terri Schiavo wanted to die except her husband's word. Also, what is the issue is merely removing here feeding and hydration (water) tubes. Can this be considered 'forcing' someone to live? It sounds to me it's just being given the necessary food and water we all require. It's not unique that an individual is not able to care for himself (herself in this case). I assume M.S. is the legal guardian and that's what gives him the legal authority to prevent her from being fed. In general, this ultimately means that a guardian can decide if his or her charge can be killed by the simple expediency of claiming they 'chose' to die in and then denying food and water to them. I'm not aware of anyone who would NOT eventually die if denied these things. (As an aside, if she can be denied food and water, can she also be denied oxygen?)
