Law to keep brain-damaged woman alive ruled unconstitutional (Baird Rules Against Terri)

TAMPA -- A judge ruled Thursday that the law pushed by Gov. Jeb Bush to keep a severely brain damaged woman alive is unconstitutional. The governor's office filed an immediate appeal.

Isolation sure sounds like abuse to me.

Michael is cruel beyond words. To think that he can walk around, feel the warmth of the sun on his skin, and not have one iota of caring for this frail, bedridden woman he calls his wife, is despicable.

A person who is deemed to fit the legal definition of Persistent Vegetative State (PVS) may be deprived of food and hydration, under certain circumstances. The law clearly defines the legal definition of PVS.

Truly, PVS is a subjective diagnosis, based on a physician's experience, beliefs, and morals. Terri neither fits Florida definition, nor the more controversial medical definition. There are no difinitive tests to distinguish PVS from either locked in syndrome or minimally conscious state.
While the law takes steps to define a medical entity, we end up with Terri Schiavo situations. Lawmakers have no business defining any medical condition. They are practicing medicine without a license. Anybody comfortable with a politician defining diabetes? How about HIE? They hijacked my profession.

On Thursday, Circuit Court Judge Douglas Baird struck down Terri's Law, the measure approved by the Florida state legislature that authorized Governor Jeb Bush to ask doctors to reinsert the feeding tube that provided Terri with food and water. "These Pinellas County judges have displayed an utterly cavalier attitude and a complete disregard for the rule of law," Terri's father Robert Schindler said in reaction to Baird's decision. I wish beyond all things that the church would grant this poor girl an annulment.

As a Catholic, I state that if Terri should be murdered, Terri's bishop would probably marry the HINO and his concubine in the cathedral.
