'Alamo' co-star charged with resisting arrest, public intoxication

Two Austin police officers were on patrol near Fifth and Colorado streets about 2:45 a.m. Monday when they spotted a gaggle of people blocking motorists trying to drive through the intersection.

Nearly everyone in the group, they said, complied with a request to move.

But a man police later identified as actor Jason Patric only shuffled toward the sidewalk, according to probable cause affidavits. Moments later, Patric and officer Joshua Visi were tumbling to the ground as Visi tried to arrest him.

The incident ended with Patric, who portrays James Bowie in the upcoming film "The Alamo" and is also known for his work in "Rush" and "The Lost Boys," facing misdemeanor charges of resisting arrest and public intoxication. He was released from the Travis County Jail on a personal recognizance bond.

"I believe it is a lawful arrest, and it is consistent with the zero-tolerance policy we have downtown," Police Chief Stan Knee said.

According to the affidavits, Patric, 37, smelled of alcohol and had dilated pupils. Visi said he initially told Patric that he could comply with the request to move or be arrested for public intoxication. After a brief exchange, Visi moved to arrest Patric, and the two got into a scuffle, the affidavits said.

"Patric pulled away from me using his left hand to push at my chest, preventing me from getting his other hand," the documents said. "I continued to tell Patric to stop and put his hands behind his head. Patric continued to spin away from me and push against me with his left hand."

The two eventually fell to the ground together before the officers handcuffed Patric.

Patric's publicist in Los Angeles issued a written statement Monday afternoon.

"Jason Patric believes he has done nothing wrong. He hopes for a rapid resolution to clear his name," it said.

LOL. Matthew bongo playing McConahay with the bong sitting in plain sight. How stupid.

If Patrick was walking or staggering intoxicated, after identifying him, Patrick should have been told to hail a cab and go to his hotel. The arrest is an intrusion and overreaction on the police's part. Unnecessary. I believe that the police tend to resent celebreties. Patrick's aging has nothing to do with anything and it's envy--pure and simple. Such ad hominins are mean-espirited and do not add anything to any discussion here at all. There but for the grace of God, okay?

It's amazing the drastic change in his face in one year between "Sleepers" and "Speed 2". Got real puffy. I thought Patric was real cute in "Lost Boys" and even "Sleepers" but he has truly gone to pot since 1997 when he made Speed 2.
Just like Anthony LaPaglia who used to be a model and was so hot. However his brother Jonathan LaPaglia is still good looking.

I loved when Matthew McConahy (sp?) was arrested with pot and bongo drums!!!! The image is hillarious. I made a vow when that happened to see every movie he ever makes in support. I'd prefer my celebs to smoke pot and play bongos then spout political diatribes. I love Matthew!!!

Ironically, this occured about the same time I was watching The History Channel last night, "History v Hollywood: The Alamo", of which Patrick was on a panel with Bill Bob Thornton and whatshisname, discussing the movie.

According to the police report, which is available at the Smoking Gun website, one of the officers simply declared Patric intoxicated after Patric had asked to be tested in order to be proven drunk. He may have well been drunk, but this smacks of police abuse of authority.

I believe that the police tend to resent celebreties.

While I don't know whether this arrest was justified, I sincerely doubt that the officers on the scene knew who Jason Patric was at the time of the incident.

actor Jason Patric

Never heard of him.

known for his work in "Rush" and "The Lost Boys,"

And that explains why.

"Rush" was excellent and he should have been nominated for an Academy Award. I don't know the guy and am not much of a fan of anyone at all but I'd like to be fair. It's the Christian thing to do.

You can't just turn someone loose for public intoxication. If they wander out in front of a car or get a mudhole stomped in them or get in their car and run over a couple of kids or plow into a family, the police officer would be held liable as he allowed the suspect to leave after determining his condition.
