Feb. 27 (Bloomberg) -- The mayor of New Paltz, New York, performed weddings for 21 gay couples, prompting the New York State Health Department to ask Attorney General Eliot Spitzer to seek an injunction blocking ``further illegal conduct,'' the Associated Press reported.

From the article on California's AG and SC just two threads down:
New York Attorney General Eliot Spitzer refused to block the New Paltz ceremonies and did not issue an opinion on whether the marriages were legal. "The validity of the marriages and the legality of the mayor's action will be determined in due course in the courts," Spitzer said.

everybody is just passing the buck. governors ask AGs, mayors ask governors, AGs ask courts, and no one is arrested. Not in Texas! The Travis County court house refused to issue marriage licenses to same sex couples. There was no need for the AG to arrest the county judge.

politically however, I think that this may well be the way to play it. if arrests start occuring, the media will make it look like a civil rights movement. if it is just allowed to continue, there will be a sense to most people of the process descending into chaos incrementally all over the country. that will build support for the amendment and Bush's position.

Because there is no "criminal" activity. Until a higher authority - i.e. court, legislature, or governor issues a cease and desist (and I think it has to be a court), the offending party is free to act.
There is no, "If you are convicted of marrying a same sex couple, you could be imprisoned for up to ...."

NPR said that the town or county clerk there refused to issue the licenses, and all the mayor could offer the gay partners were "certificates." I don't know why no one else is reporting that.

I can't believe people are even debating this absurd nonsense. Just how do you consummate a gay marriage anyway? Bubba was 100 per cent about one thing. Sex play is not sexual relations. The conjugal union of a man and a woman is has a completeness and a perfection and a beauty (not to mention a purpose) that cannot be duplicated by two men or two women (no matter how much they may love each other) any more than it could be achieved by the union of a man and a goat. A male and female chimpanzee are more deserving of a marriage license than Rosie and her gal pal.

Since no one in the various state executive branches intend to do anything exceprt wait fo the courts, can we send te "executives" home, put the judges in charge (they are anyway, de facto) and get a refund on our taxes???
Or, maybe, a batch of FReepers, accompanied by a batch of Press cameras, march in & make a citizen's arrest of Hiz Dizhonor, The Mayor?
