"The 10-year-old made the remark to a male friend on school grounds. The friend then ran over and repeated it to the girl."

The friend is the one who said something to the girl. It sounds like the friend who decided to repeat it to the girl is the one who should be suspended, if anyone.

If I say something to you out of earshot of someone else, and you repeat it to that other person, I did not sexually harass that person. Unless of course, it is clear that I intebded the joke or comment to be spread around to harass the intended "target." Does anyone really believe this ten year boy old intended to harass this girl?

This happened to my son as well. He got in trouble for this. This is why the 3 days suspension on the book cover deal, it made him a repeat offender.

What we may be dealing with here is a clear case of "thought police" mentality. What sort of flaming ass would charge the boy who made the comment to a "friend" who then told the putative 'victim'?

Only on a society of asylum escapees would the "friend" not be blamed - for if he had not told the victim then nothing would have occurred.

I suggest that the family retain a good attorney and sue a long list of defendants; the "friend", all scruel personnel who participated in this egregious misuse of authority, and such scruel system administrators as can be linked to this event.
