“…The Constitution and the Bill of Rights withholds from the national government the power to address in any lawful fashion the issue of an establishment of religion. And it, by the Tenth Amendment, reserves for the states and the people of the states the power to address that question. That means, by the way, that though these folks don't want to hear this--because this is a phrase they hate to hear; they especially hate to hear it from me because I'm one of the few people they can't accuse of racism when I raise it.

The Bill of Rights, actually, in this instance, protects a state right, a right of the states in the sovereign element which they have retained under our Constitution, another little fact everyone wants to forget. Okay?

And what the first phrase of the First Amendment protects is not an individual right. Individuals have no power to make laws. What it protects is a power of government, and it reserves that power of government to the states and to the people of the states.

Now, that, by the way, means--and here's where we get to Roy Moore and lawbreaking--that, by the way, means that even if you accepted the incorporation doctrine, what's enjoined upon the state officials is to respect those rights, privileges, and immunities that are established in the Bill of Rights. That's the argument they make.
Well, it turns out that one of the rights established in the Bill of Rights is the right of the states and of the people of the states to deal with the issue of religious establishment without dictation or interference from the federal government.

Now, if you're Roy Moore and a federal judge tells you that you must surrender this right of your state, surrender this right of your people, then you must look him in the eye and say, "By the law of Alabama and by the Constitution of the United States, I must say, 'NO, SIR!'"

And in case people are still confused, I would remind them that the doctrine that not only do you have the right to refuse an unlawful order, but in the most touchy situation imaginable--that of our military--can you think of a situation in which discipline is more important than in the midst of war? And yet, in the midst of war, the lowliest private soldier in our military not only has the right, he is under an obligation to refuse an unlawful order. And we're to say that what a private soldier in the army has a moral obligation to do is not the obligation of the highest officials in our states, when they see the rights of our states and our people being trampled underfoot by those who have illegitimately usurped the power reserved to the states in the Constitution?

Do you know what it means when you take an illegitimate power and call it your own, like someone who ascends to a kingship by illegitimate means, and then, all by your lonesome, answering to no one, you wield that power in an abusive way?

They call it tyranny."

"To my fellow Americans:

February 24th was the thirty-fifth anniversary of my arrival, at the age of 19, in what was the free Republic of Vietnam. I was stationed at Can Tho Army Airfield in the Mekong Delta from Feb.'69 to Feb.'70. The first two months I was there overlapped with Monsieur Kerry's last two months "in country". During those two months, he had to have motored his Swiftboat right past our base many times. In the year I was there, I learned how to be an unofficial "ambassador" soldier in my off duty time. Contrary to the horrendous and utterly false picture eminating from the imagination of Swiftboat Commander Kerry about we soldiers who lived among the people, we were not feared by that country's citizens with whom I became aquainted. On the contrary, I made many close Vietnamese friends who welcomed me into their homes and businesses as a friend. I had a girlfriend, Lan Nuyen, in the village of Bien Xe Moi, whose sister had married a GI and was living in Watertown, Massachusetts -- ten miles from where I grew up in Wakefield. I visited her when I returned home before losing track of them both in 1971.

Ask any Vietnam refugee, "Who was the aggressor in that war?" Ask why they chose to come here to America. Was it because we were so brutal and cruel to them, or because they knew us Americans to be kind, generous, and willing to fight for THEIR freedom? It was the Kerry testimony at the Congressional hearings in 1971 that gave the American soldier in Vietnam a false and disgraced reputation. His word is not to be believed. He can not deny that his public professions hurt our efforts to end the war with a positive result, otherwise known as victory. Neither can he deny the smearing of my reputation as a patriotic American, along with my brothers, who sacrificed blood, sweat and tears in an effort to hold back the tide of totalitarianism and its slaughter of innocents for the Communist ideal.

I am proud to be a Vietnam Veteran. I am ashamed that the actions of one of our own did so much damage to our cause, which was to secure the liberty of a people in a small far away land, which we abandoned to the enemy in part because of his political ambitions and lies.

They are...and don't think you and I are the only lunkheads noticing...once the American people get to know Kerry and whoever's the unlucky stiff he chooses to run with him, as soon as they get a whiff of the RATS' duplicitous lies and utter fabrications, they're gonna elect Dubyuh in an '84-like LANDSLIDE!!

Next few months may get testy, but I don't see Kerry laying a hand on Dubyuh in November!!

One of many issues he's vulnerable on...heck, it's set up now that the Pubbies are fer extending an existing tax cut and the RATS are running on a platform fer raising our taxes!! That's got Mondale written all over it. If we can just get Dubyuh to lay off the Amnesty proposal and start trimming the Federal largesse in the upcoming budget debate, I see a very good outcome next autumn.

Howdyy, Cuz...Wonderful letter and I'm sure it's a wonderful family. Still, even if Bob and Steve live happily ever after in a blissful existence, nothing they can do will change the fact that they are not--and will never be--married!! A marriage is a holy union between one man and one woman...it always has been and always will be. As various States and Localities try to challenge this fact of life in the Lib'ral Justice system, President Bush and the Nation are left with no other alternative than to reaffirm the long-revered concept of marriage with a Constutional Amendment. This is no slap at the Gay Community, as they should be granted Civil Union status and the like, but they needn't persist in trying to juxtapose their Post-Modernistic viewpoint on America. Call it "coupling" or whatever, it simply isn't "Marriage."

House of Delegates Speaker Bill Howell has come through for those who oppose the massive tax hikes proposed by Senate Republicans.

According to the Washington Post,

"The House speaker's choice of budget negotiators doesn't help matters, [liberal Democrat Sen. Janet D. Howell] said. He broke with the tradition of appointing the most senior members of the Appropriations Committee, skipping over some who are viewed as centrists to add one of the House's most conservative members and an anti-tax Democrat to the five-member team. House Republicans shouted, 'Hold the line!'and 'Fight like a Greek hero' as they congratulated Del. M. Kirkland Cox (R-Colonial Heights) on his appointment." (end of Post quote)

This is good news. My man Kirk Cox is a true fiscal conservative.
