S.F. to Sue State Over Gay Marriage Ban

SAN FRANCISCO - After sanctioning more than 2,700 gay marriages in the past week, the city said Thursday it is suing the state of California, challenging its ban on same-sex marriages on constitutional grounds.

City Attorney Dennis Herrera planned to file the suit in the afternoon, said his spokesman, Matt Dorsey.

Two judges already are considering challenges from conservative groups seeking to halt the marriage spree that began last Thursday. The city's lawsuit asks that those cases be consolidated into one case.

The city is asking Superior Court Judge James Warren to declare unconstitutional two sections of the California Family Code that define marriage as a union between a man and a woman.

City officials want the judge to determine if restricting same-sex couples from marrying violates the equal protection and due process clauses of the California Constitution.

On Tuesday, Warren gave the city the choice of ending the same-sex wedding march or returning to court in late March to show why the process has not been halted. The city said it would continue issuing such licenses until forced to stop.

Well, looks like Prop 22 is about to go the way of Prop 187. Because the Leftists can't get their way at the ballot box, they once again use the courts as their personal special interest trump card.

But at the heart of it all, I'm left with just one burning question: Why isn't Governor Schwarzenegger upholding state LAW in this matter??

If we don't get self-government anymore then we should at least save money by sending the legislators home to find new jobs.

The Attorney General, Bill Lockyer, is the one who needs to charge Gavin Newsom with violating the law because he ordered city clerks to break the law. He needs to charge the clerks who altered the application wording as well.

The Governor can't do this, only the Attorney General. We should be flooding his office with complaints right now.

I'd like to thank the fruits and liberals for making one of my favorite cities to visit one of the last places on earth I would want to be.

Those of us who work here are stuck...at least for a while. Actually, it isn't that bad any more. I just tune it out and accept it as the way things are. I can still enjoy the good things about San Francisco as long as I don't worry about changing the place for the better. My long-term future plans don't include living here, so let them do what they want.

It's kind of the same philosophy we're using in Iraq: draw al Qaeda in and let them attack our military forces instead of having them come to America and attack our cities. By keeping all the radicals in San Francisco, at least we know where they are, and any initiative that comes out of San Francisco is automatically seen as wacky by most Americans, even by many Democrats.
