Vermont Court Rules Against Dean in Records Lawsuit (CNSNews.com) - A Vermont court Tuesday ruled against Democratic presidential candidate Howard Dean and the State of Vermont in a lawsuit brought by a public interest group seeking access to Dean's gubernatorial records.
The court ruled that a private agreement between Dean and Vermont could not be used to prevent the public access to Dean's records. Dean's attorneys had asked the court to summarily throw out Judicial Watch's lawsuit, rather than letting a judge decide.
As a result of the ruling, Dean must detail the records he is seeking to keep secret and explain specifically why they should be subject to executive privilege. Until not, Dean has refused to detail to the court or to Judicial Watch the nature of the documents he is seeking to seal for 10 years.
"Howard Dean is now getting a lesson in government openness. The court ruling pierces Dean's veil of secrecy and begins to open up his gubernatorial record to public scrutiny," said Judicial Watch President Tom Fitton.
Dean had used his presidential run as the basis for denying the public access to the records, telling Vermont Public Radio and other news organizations, "Well there are future political considerations. We didn't want anything embarrassing appearing in the papers at a critical time in any future endeavor."

It's not an entirely fruitless endeavor, JC. All those brainwashed kids who blindly and enthusiastically followed Dean will now get to see who and what he really is. That could have an effect far beyond this year's election season.

Rumors are that Dean's fall back position will be that the records of all the late term abortions he and his wife performed on young black girls from Boston and NYC in a state owned facility are priveledged under HIPAA(?). Since he can't afford the appeal and it is likely that Vermont really doesn't care, it is also rumored that he'll ask the federal government under it's administrative rules, to keep at least these records sealed.
