LEGISLATIVE COUNSEL'S DIGEST

SB 1160, as introduced, Cedillo. Highways: drivers. Existing law makes it unlawful for a person to drive a motor vehicle upon a highway unless that person holds a valid driver's license issued under the Vehicle Code, and provides proof of financial responsibility. This bill would express the intent of the Legislature to enact appropriate legislation that improves the safety of all California residents while operating motor vehicles upon our highways by ensuring that all drivers of motor vehicles are properly licensed, tested, and maintain proof of financial responsibility. The bill would declare that it takes effect immediately as an urgency statute. Vote: 2/3. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. It is the intent of the Legislature to enact appropriate legislation that improves the safety of all California residents while operating motor vehicles on our highways by ensuring that all drivers of motor vehicles are properly licensed, tested, and maintain proof of financial responsibility. SEC. 2. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: In order to reduce the number of unlicensed drivers on our highways, who account for 20 percent of all accidents and, thereby, compromise public safety, it is necessary that this act take effect immediately.

OMG!! They introduced it as an emergency bill, meaning that it goes into effect as soon as it's signed! However, I don't believe they'll get the 2/3rds vote to have it pass as an emergency bill. If any Republican legislators support this, they'll be unemployed after November 2.

If it passes as an emergency bill, the damage will have been done before a Referendum can be placed on the ballot to repeal the bill - there is no way to retreive the millions of DL's that will have been issued by that time.

If it doesn't pass as an emergency bill - Cedillo will re-introduce it as a "regular" bill, which means it can't go into effect until 1 January 2005. We'll have the referendum qualified by then - and the law will be held up until after the next election where this Referndum will appear.

Simply herd them into the busses behind the building when they show up to get their licenses, and they could be in Tijuana by the next morning (nightfall for San Diego and L.A.). Have the INS greet them at home if the busses get full.

Same for college attendance.

Assembly: 80 Seats: 48 Dems, 32 Republicans - 2/3 = 54

Senate: 40 Seats: 25 Dems, 15 Republicans - 2/3 = 27

Therefore, they need 2 Republicans in the Senate and 6 Republicans in the Assembly to vote YES, for it to pass as an emergency bill.

The Republicans held the line last year when it came to voting against any tax increases, and all the Republicans voted NO on SB60 - last year's version of the Driver's Licenses for Illegals law.

However, that was with a Democrat in the Governor's Office. Now that Arnold is in there, I'm sure there will be some arm-twisting on some Republicans to get this passed.

I think what Lizavetta was getting at is that here in California proof of insurance is only required when you register a car. It's not needed just to get a license. (Is that what you meant, Liz?)
