Checked with AG's office and AG says the files are public records except there are two letters which include plea negotiations which are not normally to be revealed so may or may not be public record.

He doesn't have to sqirm out of anything. He had a medical condition and sought treatment from as many docs as he saw fit to get help from. He wasn't looking for pills, or to get high. He was looking for healing and didn't find it. The addiction was a side effect. Had the pills been addictive antibiotics, the same would have occured.

See doctor shopping requires the intent to obtain pills. Rush's intent was to find healing.

MDLM was commenting on the SOURCE of the drugs. The basis of MDLM's comment was from a highly unreliable account.

MDLM was NOT commenting on what motivated Rush to seek treatment for his addiction. I will concede that the public airing of his addiction (through the Enquirer) is what motivated Rush to go to rehab.

However that is irrelevant to MDLM's statement.

What charges? With every passing day and new piece of information it looks more and more like the only drugs Rush took were those obtained by perscription. The SA would not have gotten his own butt in a sling like this if he had something to work with.

IMHO he will continue his fishing expedition hoping to find something, but no charges will ever be filed.

It may never happen where Rush lives in Florida, but there are places all over America where it happens all the time. I can think of several cases locally where people were arrested and convicted for "doctor shopping." We had a case a while back where a prominent local news anchor was charged and his case went to trial. He was addicted to hydrocodone and was going to doctors all over town getting multiple overlapping prescriptions. He even tried to get my father who is also a doctor to prescribe him pain medication. He was acquitted at trial though probably because the jury thought, like my father, that it was a pretty crappy thing to do to go after someone in this type of case who had a legitimate health condition and became addicted to the drugs he was prescribed for it. Incidentally though rumor has it that this guy was fairly heavy into cocaine and other drugs before the neurological condition for which he was prescribed pain medication ever surfaced.

Anyway, it certainly does happen all the time in the in many states. And I keep hearing things that indicate a common misconception people have. People seem to think that it's a nationwide policy to seek treatment rather than punishment for drug addicts, especially those who became addicted to drugs they had been prescribed. This is not the case. Treatment not punishment may be the policy in many places in America, but certainly not everywhere. Moreover, the law itself doesn't delineate in most if not all states between people who got hooked on drugs they had actually been prescribed and people who bought these drugs off the street and got hooked. And regardless of whether states or counties have a "treatment not punishment" policy that does not necessarily mean the accused in these cases get away without being prosecuted and convicted of a crime, which in many cases turns out to be a felony that stays on their records. Even where they favor treatment over punishment, people are still prosecuted for these crimes. They just might not end up doing any time over it and if they are lucky enough to be in a state that does things like deferred adjudication they might be squeak by without a felony conviction on their records.

I haven't been able to keep up on the latest info, but I thought Rush's problems stemmed from the Enquirer articles use of emails and telephone transcripts to show Rush was feeding his problem with "shopped" prescription drugs. Is this no longer the case?

Yes I have erad what the enquirer calls an "article". Sounds like she should be charged with extorsion as well. Or maybe she should be charged with "tabloid shopping" since this wasn't the first time she'd tried to sell this trope to a tabloid.


My ex-wife had a problem with ephedra. She took up to 2 1/2 bottles a DAY at times. Should I go to the DA in my hometown and demand he prosecute the owners or managers of the stores or say that my ex should be charged with "7-11 Shopping"? Becasue she went to so many different stores to buy the piss that gave her her fix?

Oh wait you say...ephedra was legal at the time and could be bought over the counter.

As far as we know, all of Rush's scripts were legal. He did nothing wrong in taking legally aquired prescriptions to the pharmacy to be filled.

And since when does ANYTHING written in the Enquirer constitute either ethical journalism or something admissible in a court of law?

I have. Checked out 2. One's drug of choice was Oxcontin. Walked out of that office before appt. When I heard patients begging for their Rxs, it was time to go. Next doc explained options, dangers, etc before we settled on a treatment plan. He did not push drugs and the appts were controlled, every 28 days, Rxs filled every 28 days. And the drug of choice was NOT Oxycontin.

This is how Rush's situation broke into public view. However there has been no evidence presented to indicate that the maid's allegations were cooberated in any way. There are charges from Rush's attorney that the maid was blackmailing Rush. The States Attorney has turned his investigation in several direction looking for something to get Rush on.

In a normal investigation, the authorities examine evidence to find who committed a crime. In this case, they have devolved to the point of examining evidence to find a crime. Indications are that they aren't finding one.
