COPPEROPOLIS -- A retired couple's dispute with their homeowners association has spiraled out of control in this Calaveras County community -- and now they have lost their home less than a year after failing to pay $120 in annual dues.

Ok, here's where I insult everybody and probably get kicked off the forum - I told my husband I was on a website where people were bad-mouthing an investor for recognizing a good deal and taking advantage of it, and he said - you must be on some liberal-communist type bulletin board. It can make one feel like a vulture sometimes, but I have to remind myself that I didn't cause the situation. If this type of reasoning helps you sleep at night, fine. I believe in giving people fair market value for their property, even if they're old and have a lien. What is liberal and communist about that?
If I had a job that made me feel like a vulture for even one day I would get in another line of work.

The information below came from researching the County Recorders Offices
The individual who purchased the property @ 1057 Quill Rd. Copperopolis, Ca 95228 is
Robert Vardanega. P.O. Box 1151 Alameda, CA 94501
He purchased the property at public auction on the Calaveras County court house steps
December 18, 2003 for the sum of $70,000. On the very next day his wife Mei Na Zu,
filed an inter-spousal quick deed transfer.
In my search of County Recorder Offices on-line I found Robert Vardanega in 8 of the Counties that offer on-line capabilities they are.................

I daresay that you do not understand what the American and British legal system ARE. Our very liberty has always started with the judiciary which DID "make the Common Law" as it went along.
If you want to live in a world where judges cannot make any distinctions at all then go somewhere where the Code Napoleon rules all and judges have no discretion whatsoever.
The Constitution is rooted in and requires the Common Law. You can't separate the two.

The key to the notion of Rights is that yes, you have Rights, and by the same token you must recognize the Rights of others.
This couple did not recognize the rights of others and the system worked to protect the rights of others who had an interest.
The couple agreed to trade something of value for services that were provided. They promised to pay and created a property right for the service provider. The service provider kept their part of the deal.
This is about protecting the concept of property rights.

Another libertarian who doesn't believe in paying their contracted debts? Weak, very weak. It's not a Libertarian issue, this is an American issue. Stuff like this shouldn't happen in America. Do you actually agree with someone stealing the house right out from under an old, retired couple over a measly $120? I hope not.
And for the record, I pay all of my debts, my credit rating is spotless.
