Palm Beach State Attorney’s Office Dances Atop Their SUV, Releases Confidential Correspondence

Roy Black Comments on the State's Release of Confidential Correspondence

Miami, FL – January 23, 2004 – Roy Black, attorney for Rush Limbaugh, issued the following statement today regarding confidential correspondence that was released to the media by Palm Beach State Attorney Barry Krischer.

“My letter to Mr. Krischer regarding Mr. Limbaugh’s case asked that Mr. Limbaugh be afforded the treatment anyone else would receive. The State's response was preposterous, but consistent with their double standard in this case. The facts are: Mr. Limbaugh went to these doctors to relieve chronic, intractable pain; there was no doctor shopping. Mr. Limbaugh never considered accepting the State’s ludicrous offer. He was not going to plea to something he did not do. We sent them a letter suggesting Mr. Limbaugh be treated in a similar manner that others had been treated. They responded with a preposterous offer. Discussions ended at that time. At no time was there ever a plea agreement of any kind.

"What the records don’t show is that before we could draft a letter responding to the State, we received a phone call from a newspaper reporter, as a result of a leak by the State Attorney’s office, asking us whether Mr. Limbaugh had agreed to enter a plea. As I told the court last month, we think the State Attorney’s Office should be investigated for journalist shopping.

"What is most troubling here is the continued violations of Florida law and bar ethics by the State Attorney’s Office. One need look no further than the bold caption on top of my letter alerting everyone to the confidential nature of the communication. The disclosure of these highly confidential communications violates the Florida statutes, the rules of procedure and evidence, and the Florida Bar Rules governing professional conduct. Because the State has no case against Mr. Limbaugh they continually seek to discredit him in the media.”

Rush was in so much pain that he was only able to play golf three or four times a week.

Playing golf may be evidence that Rush does not need to be confined to a wheel chair. But it is not any kind of evidence that he did not experience episodes of intense chronic pain.

I have some very painful dental problems right now (impacted wisdom teeth). Yet I can do many ordinary things, even eating.

The statory provided for FL drug court intervention program is a pre-trial intervetion program which allows treatment in lieu of prosecution. No admission. The end of treatment results in the case being dropped. Not dismissed. Just dropped.

The only requirement is an admission for the need of treatment, something Rush has done.

This was a win win negotiation. The SA wants a felony conviction to keep Rush off his civil rights.

This is SOP with a user case. Find out the intent of the prosecutor. In this case the prosecutor office has no interest in reason, only political gain. It was an absurd offer designed to elicit a rejection. The SA tipped the press to gain futher political gain. Its all BS.

My question is NOT flawed; if you're not guilty of SOMETHING, there is no need for any type of deal, period.

I will make you a deal. You go on believing this above psychotic assertion, and I will not believe it.

Thus by your own standards YOU MUST BE GUILTY. Unless you decline my deal, and admit your wrong.

His vocal chords were, once again, clearer, and he was not garbled by phlegm. By Friday, now, the phlegm is overwhelming. And when he really loses it, the phlegm sticks in his mouth and he transposes syllables. He knows this and tries hard to overcome it, but the lure of the weekend high is too much.

I listened to Rush for about 10 minutes Friday while I was driving. I think I heard the garbled speech to which you refer. It sounded as though he had something in his mouth -- either he was eating something as he spoke or, more likely, he was holding something in his mouth, probably between his teeth, because he had his hands occupied with something else. I heard him go back and forth between speaking with something in his mouth and speaking very clearly.

Ah, and with Limbaugh, there's a much bigger payload: he wields a lot of power with that radio show of his. Liberals would very much like to silence that voice--and if they can't silence it, they'll discredit the man.

Guilty people enter into deals all the time. The justice system would become overloaded without the ability of prosecutors and defense attorneys to negotiate sentences and preclude jury trials. If Limbaugh is currently receiving treatment for his addiction, it's perfectly logical for his attorney to seek a deal which would avoid prosecution if he continues his present course of action.

Seems pretty straightforward to me.

From the first moment I heard that Roy Black was the attorney for Rush I knew Rush was in trouble. Black is without ethics and ought to have been disbarred for his conduct during the Willie Smith rape trial. He was having an affair with one of the jurors in that case. Subsequently, he divorced his wife and married the juror. Soon he was sporting a pony tail and pretending to be a young stud.

That is shocking info about Roy Black.
