Foyil Edward Deal, 63, says two men stormed his home and forced him to withdraw cash from an ATM Tuesday morning.

On the drive home, Deal, who has a concealed handgun license, says he pulled out a pistol from his pocket and shot Wesley Lewis Duncan, 40, and Wylie Bailey Casey, 35, in the head. "They may have known about him, may have known he had monies," Detective John Brimmer (pictured, left) said. Deal is in the Dallas County Jail after a judge set bond at $750,000. A grand jury will hear the case to decide if there is enough evidence to prosecute the case. Consuelo Mendoza is standing by her neighbor's story. "I can only tell you that people have been coming in and out of there that we don't know, that is not normal for him," he said. "For him to have done this, he would have been extremely threatened," he said. Duncan had a lengthy criminal record that included burglary charges.

I think it should be a $5 mail-in fine to shoot anyone on the street who asks you for cigarattes or money. The guy in this article should get a medal, pinned on him in public, with cheering crowds, like at the end of Star Wars.

Seems to me that I've heard about an old Texas judicial custom of excusing such shootings if the perps "deserved shooting". I also was under the impression that deadly force was considered justifiable in the case of a home invasion. Anybody care to enlighten me on the current state of the law?

They kidnapped him from his home and forced him to withdraw money, he then felt threatened enough on the ride back to shoot them.
In my opinion this guy showed an amazing amount of restraint from the outset.

Sounds like he may have had the means, but not the opportunity to resist until after the money had been withdrawn.
Convene a Grand Jury, make sure things were as up and up as they appear, give this guy a community service award and send him on his way.

Texas judicial custom of excusing such shootings if the perps "deserved shooting". The legal test in Texas is not whether some one "deserved shooting." The proper term is that the person "needed killing."

There was a similiar shooting in Memphis last summer. Two perps kidnapped a man and forced an ATM withdrawal. Then they took him to his home. Perp #1 went to the kitchen, Perp #2 followed the victim to the bedroom, whereupon the victim turned the tables and killed him. Perp #1 came to the bedroom to see what he no doubt thought was going to be Perp #2 standing over a dead victim. Imagine his surprise when he caught the next salvo. (I think he survived, though. I seem to recall that the "victim" in this case subsequently decided to buy a larger caliber pistol.)

More than likely, after they got the money, the perps were probably discussing what to do with the victim, and that's when he knew it was either him or them.

A similar event took place in Wichita Kansas but with a strikingly different result. The homeowners had no weapon for self defense and were thus raped, beaten, and then executed.
Maybe these idiot police officers should talk to the lone survivor in Wichita about what a difference the threat of deadly force can make.
