WEST PALM BEACH, Fla. - An appeals court Tuesday ordered prosecutors to surrender Rush Limbaugh's medical records to a circuit court and keep them sealed until the appeal is further reviewed.
The 4th District Court of Appeal also ruled that the American Civil Liberties Union can join the conservative radio commentator in fighting to keep the records private.

But, but... there's nothing in the records... the records prove that Rush is completely innocent !
... Now would be the time for the bad guys to "leak" whatever "information" they want that ISN'T true... I wonder how Black would handle that ?

This is a HUGE win, win, win, win situation for the ACLU !
It appears that Rush's Kennedy Lawyer told him to "sit down and shut up" a few weeks ago and he meekly complied, but what could possibly possess him to allow this to become the circus that it surely will ?

Or how about the fact that active resistance to having his privacy invaded is the kind of thing Rush would have us all do? If I were him, I'd be fighting this because of the mere principle of the thing.

Your assumption that the investigators would simply toss them out is flawed - They had the Clines information on him for a year and nothing at all leaked, they have had the records since november and nothing has leaked, they have even had a look at them in December and nothing has leaked.
Sorry about what you would LIKE to believe, but reality proves you wrong so far....

The ACLU volunteered. They were not asked. Actually they are in this because they see this case as opening the door to abortion medical records.
Their involvement has nothng to do with rush. They are not even filing on his behalf. They petitioned the court for permission to file an Amicus Brief.
Anti-Rush groups are free to file for the same permissino to argue that medical records should be obtainable outside of legislativly outlined laws. (not that judges respect black letter law in FL)

... and what an amazing coincidence that they would seize his records from the investigators on the same day !
Just where were they when medical records from hospitals are routinely searched in DUI cases ?
