Yes! And I don't think Malvo will find a favorable jury in Montgomery County. He killed a wonderful lady and seriously wounded another. The women he murdered was black, the women he wounded was white.

It was in a letter to another inmate, written after the defense said he had pulled away from Muhammed. It sounded just like the Malvo who hadn't pulled away from Muhammed.

I don't know how Virginia assesses prisoners in their intake, but any escape, escape attempt or escape threat earns a prisoner one or two notches up on the security scale (eg, from medium security to maximum security; maximum security to super max).

If I'm not mistaken, Malvo shot one of the women in the face, but she survived. The other was chased down and murdered. They found a fingerprint of Malvo on a magazine found at the scene and they have a match to the gun used in the DC shootings.

There's more evidence, and there may also be a police ID (from the chase after the shooting).

I believe you are correct. The women were closing the State Store on Zelda Road when attacked. There is a fire station close by, so witnesses were on the scene quickly. From what I understand, Malvo was chased on foot by a Montgomery Police Officer. I think they have lots more evidence on this scumbag.

Cold blooded killers need to die!

This truly boggled my mind. But then again, after a jury found the defendant not guilty in the case where he admitted shooting a man and chopping him up and disposing of his body (because they couldn't find the head and therefore prove there wasn't a little "scuffle") nothing can shock me anymore!!! He is suspected of murdering his wife and her friend also, right before the friend was to be questioned concerning the wife's disappearance. World turned UPSIDE DOWN!!! My prayers go out to the family members of this little "bleep!"

There are two sides to VA, Northern VA, and the rest of us. In fact, Southwest VA (my part of the state) is much more conservative than the area where Malvo was tried. He would have fried if tried here. Even we females would have voted for that.

So reprehensible decisions like the Malvo verdict should be laid at the doorstep of the Supreme Court.

Hello, the Jury has no responsibility in the matter? Even without this a Jury could still go squish by finding guilt of something less than capital murder. All that changed is how a Jury that wants to go squish, will go squish.

I can understand the disappointment of the sentence, but the animosity towards the Commonwealth of Virginia is certainly misplaced. I would suspect several jurors would not impose the death penalty and the others just wanted to go home for Christmas ignoring their civic duty. I allocated about 15 minutes to research the death penalty in the US. Virginia is second only to Texas in the number of executions performed since 1976 when the death penalty was reinstated. On a per capita basis, Virginia exceeded the execution rate in Texas at least until 1998. Of the states where Malvo may be charged for murder, only Virginia and Alabama impose the death penalty for minors (the federal government does not). Alabama has not executed a juvenile convicted of murder since 1976, Virginia has executed four.

As a native son of Virginia, I can attest to the conservative values of the state. Virginia is the cradle of American democracy (Jefferson, Washington, Madison, Monroe, Mason, Henry, …) and although not geographically the heart of the South, it’s the soul of the South’s beliefs in federalism and individual rights. Since leaving the Old Dominion, I have lived in Florida (1 yr), Alabama (4 yrs), Georgia (10 yrs), SC (3 yrs), and NC (2 yrs). I know the South is no monolithic entity. Virginia itself is no exception—the people of Tidewater, northern Va, the Great Valley, and southside are derived from different heritages but the state, as a whole, is a conservative state. In 1996, Ark, FL, LA, and TN voted for Bill Clinton, Va did not. In 1992, Ark, La, TN, and GA voted for Bill Clinton, Va did not. In 1976, every state of the Old Confederacy voted for Jimmy Carter with the exception of Virginia.

Is Virginia a southern state? The Confederacy would not have lasted 6 months without the leadership of Virginians (Lee, Jackson, Stuart, AP Hill, Ashby, etc.) and the state’s resources. Undoubtedly, the urbanization of northern Virginia and the Hampton Roads area and the associated influx of outsiders have changed the character of these areas. The same is true of Atlanta, Charlotte, Birmingham, Houston, etc. In many respects, the South is being homogenized with the rest of the country. It is my hope the South, including Virginia, will always be a bastion of federalism and individual rights.

If these jurors were faced with a choice of sending Malvo to the electric chair or letting him back out on the street 30 seconds after the trial ended, I think it is safe to say that Malvo would be sitting in "Ol' Sparky" right now.

This would be asking for a lot of hung juries.

This sucks. Do we have any juries left who will administer the death penalty? These were Islamic terrorists! Does the jury know this?

No problem -- as long as the prosecution is willing to re-try any such cases. Since the scenario I described is only for capital cases, it is likely that the defendants would not be out on bail anyway.
