It is better to ask for "forgiveness" than for permission.

A religious liberties law firm threatened to sue over the incident.

Who are they going to sue? The 8 year old? His parents? Or the school?

So, let me get this straight an 8 year old is expressing his religious liberty and a religous liberty law firm is going to sue because of he is willing to express his liberty. I know that this begs the question, but isn't that
what they should be fighting for?

I would go buy every candy cane in town and get a large number of Christians to drop them off a few candy canes with(Oh the horrors of it all) a Christmas card at the law firm all day long until Christmas.

It's a "holiday party", not a "Christmas party".

If any of the other students were allowed to distribute small gifts to their classmates, then this child was obviously singled-out for discrimination.

The school should encourage "diversity" and allow Christian gifts at the party. They school can also teach history, government, and geography as it related to the Christmas holidays.
