See Article I Section 4. Such a law as this is part of the "manner of holding elections" which are "prescribed in each state by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators."

Yes they can regulate the manner of holding elections. But they can't do so in such a way that it abriges the freedom of speach, or of the press, or the right of the people to peaceably assemble. I think the law does all of those things.

The first amendment, being an amendment, overules the powers of Congress granted in the main body of the Constitution.

The Bill of Rights died this month, after an extended illness. First the nine in black declined to even rule on a law which grossly infringed upon a fundamental right protected therein, and now they rule in direct opposition to another provision.

In 1267 you make a correct observation about 53. There are 1214 posts in between and the poster you made that goofy observation has already dug himself deeper and deeper in since then. He still maintains it despite logical and correct posts by many many others making your point as well. You will win the "beating your head againt the wall" award if you go around with him again. LOL

The airways have been treated differently since their inception. We already regulate what can be said and who can say what on the airwaves. That speech has already been violated. Extending the govt reach to advertising before an election is no biggie.

If we were going to get all upset about the ad bans we should have spoken up when the feds banned foul language, nudity, violence as well as tobacco and alcholol advertising.

All this ruling does is say that political advertising doesn't have more rights to free speech onthe air waves than a tobacco advertiser.

This is just silly any candidate can run ANY ad he wishes at ANY time with ANY content as long as it is funded with hard money. Only the stupid ones will be crimped by the ban on soft money ads.

All those in the Chicken Little Brigade seen to ignore this FACT. Wonder why?

It is quite tiresome to constantly be told over almost every issue that the Constitution is destroyed! the Nation is finished!! the Gulag is just around the corner!!! Ever hear of the Boy Who Cried Wolf?
