The only one that matters as far as that's concerned are Court records.
And I dare you to point out the media outlet that's used the words "known pedophile" when describing Michael Jackson during broadcast, or in print.
Show me.

I guess we should have listened to the people in FR arguing that David Westerfield was not guilty of murdering Danielle Van Dam.

Rizzo, LeToy's ex-husband, and others who have more inside information than any of us have labled Jacko a pedophile. Now his letters, the deposition of his first accuser, and his connection with a mob figure sure paint a horrible picture.
What is fact is that he is abusing children he claims are his. Imagine forcing them to wear veil or animal masks and dangling a baby from the balcony. If it were us, there would have been an investigation and CPS would have been involved.

cant be charged for a handshake. Also included is that the touching has to be with arrousal of the perp or child or intended to arouse the child or something to that effect. I don't think a simple handshake would be calculated to arouse.

Cute little "if it looks like a duck" sayings are not called for right now, sometimes looks are deceiving (you know that cute little saying, don't you?), what's called for right now is an intense investigation to settle the question once and for all.
If Michael molested this child, and I mean molested, not hugged, or held, then he should go to jail, if he did not, then this kids mother should go to jail.
If you want to judge people on their appearances, or because they are out of the norm, thats your prerogative, Ill wait until something is available other than accusations and media hype to begin making up my mind.

If Jacko gets off by shaking a kids hand, then, the definition fits.

I'm not minimizing the effect of this kind of behavior, I"m just saying that it's not as bad as murder as you're saying it is. That's all. Of course murder victims don't suffer for decades after the crime. Ask any woman who has been molested by a family member.
I have to say that a lot of what has been presented on this thread is very questionable. I would never leave my children alone with an uncle who made a habit of kissing school-aged children. I suppose culture makes some difference here, so if I'm out of line, bring it on.

In fact, they inititiate it usually. I am the father and protector they never had because their own father was an abuser and molester. Only at my house were they ever really safe. I am treading on thin ice here, but I spent seven years in children's protective services. Where and how do you suppose the kids learned that hugging and kissing men other than their husband is the usual and customary approach to friendship between girls and men?

Wow...so you think his crime as described should be punished the same way you would punish a murderer?
I'll go a step further. If evidence shows that Michael Jackson is guilty of child molestation, I'd like for him to get the death penalty or at the very least, life in prison with no parole. Ditto for all pedophiles. IMO, they're similar to murderers. They kill the innocent lives of children. Its high time that the punishment fit the crime for perverts who ruin the lives of children, preying on them for their own deviant self gratification. It is a fact that pedophiles cannot be cured & continue to re-offend. Society has been negligent in dealing with these vermin & we need new laws to address fairness and justice.

The statute requires that lewd and lascivious act(s) must involve touching the child's body. In your other odd example of handshaking, do you actually believe a District Attorney would charge someone with handshaking and try to prove to a jury beyond a reasonable doubt that the perp is being sexual aroused or gratified by shaking hands? DA's usually don't go to trial unless they believe they have a very good chance of winning a jury verdict. Of course, they're not always right about the strength of their case (the Bryant case in CO comes to mind), but if you're seriously suggesting that Jackson might be charged with something as benign as shaking a child's hand, there's not much to discuss.

You're quoting someone that MTV dug up. I'm quoting the exact penal code DeSales is an Orange County criminal defense attorney and former prosecutor for Los Angeles County. The fact that MTV is quoting him doesn't detract from his credentials.
288(a): Any person who willfully and lewdly commits any lewd or lascivious act, including any of the acts constituting other crimes provided for in Part 1
You might check Part 1 of the statute to see what crimes are provided for there.
When the Santa Barbara guy was giving his news conference, he made it a point to say that it wasn't oral copulation
Whether or not Jackson is being charged with oral copulation, I don't know. If the DA said no in a press conference, then I'd believe him. I didn't see the news conference. But, Section 288(a) would be the appropriate code with which to file that charge.
