Judge finds fertile grounds to convict gun-wielding farmer

A Great Meadows farmer was convicted of possession of an assault weapon Monday following a brief trial in state Superior Court.

The charge against sod farmer Dennis Pryslak surfaced last year as state police were investigating an incident in Pryslak's farm store, authorities said.

I think New Jersey edges out California for having the most corrupt, unconstitutionally inclined state government including insanity in the judiciary.

You mean more than Illinois, Maryland, Massachusetts, and Connecticut. I don't know. It would be hard to pick the most anti-Constitutional state.

I guess that this assault weapon just drops "bullets" on the ground. A "bullet" by itself is about as useful as a spitball. Seems to me that a casing, primer, and some powder might make just a little bit of difference in the recipe to making a round. As usual, the media = flippin stupid.

The legal principle of mens rea has been part of Common Law for many centuries. It has been under increasing assault in recent decades. Violating the principle violates one of the fundamental rights referred to in the Ninth and Tenth Ammendments of the Federal Constitution--and which the Fourteenth Ammendment obligates the States to also respect. See STAPLES v. UNITED STATES, 511 U.S. 600 (1994).

A number of on-line companies will not sell 15 rd mags to NJ residents, because the specs for the mags are not that tight. Some of the 15 round mags can squeeze in a 16th round. The bullets will be so tight the bolt of a weapon cannot chamber it, but the gunowner can still be arrested and charged with owning components for an assault rifle. My favorite NJ gun law incident involves a Ruger Mini-14 rifle. The individual owned a Ruger Mini-14 (GB model) rifle semi auto version that originally came from the factory with a folding stock. Knowing the NJ law forbids folding stock, the individual replaced it with a full stock. He thought he met the law, but got into trouble because the receiver of his rifle (had the offending serial number) indicating a folding stock model, made his rifle illegal. He argued that technically his rifle no longer possesses offending features and capabilities, and is no different from the legal versions of the Mini-14. The judge ruled that according to the law, the receiver on his rifle is part of the GB model which is banned (there is no physical/functional difference between GB receiver and legal Mini-14 receiver, only indicator is the serial number), thus possession of it in a rifle configuration that is legal, is still a violation of the NJ Gun Ban pertaining to parts. In NJ most judges catching a law abiding citizen in a technical violation usually ends in a deal, where the gunowner surrenders all his guns and promises to give up his right to own a gun or face prison.

Ah yes.....the Peoples Republic of New Jersey. Did you know you can't even order a slingshot by mail order in this state ? You need a firearms id to buy a BB gun? Its sickening. And the crime stats are high accordingly.

Whew. That was close. My AR-15 prebans shuold be okay in NJ then, since they hold 30 cartridges, not 30 bullets.

"The expert from the state police said there's no way anybody could tell the capacity of the magazine," Gosh, not only corrupt, but stupid too. The guy who loaded the magazine would know, at least approximately, how many rounds it could hold, even if he had to take off his shoes to count. Some expert.

What has been changing the USA towards a fascist (corrupt socialist) state is the way law is written, enforced, and ajudicated.

Our RATIFIED Constitution stands in the way of the high priests of governance, so it is ignored.

Convoluted law is passed and signed into law, often for regulators capricious dreams, those laws and regs enforced -anything but uniformly, and true RATIFIED Constitutionality tests are rarely applied, correctly for sure, by political, agenda driven blackrobes.

If this law stands, any semi-automatic pistol and rifle, and shotgun will be defined as an assault weapon to be banned, under penalty of law.

Corrupt politiicans in or out of blackrobes cannot allow We the People to keep and bear arms. Perfect example of mens rea.

The only firearm that comes to my mind that would carry 17 cartridges in the mag. when fully loaded is some of the older semi-auto Marlin or Glenfield .22s with front load tube feeds.

I wonder if it was just a .22 LR.

That would be the best cartridge for the farmers' uses and there are more of those old Marlins around than about anything else.Hardly an assault rifle.

Either that or a pistol with a double-stack magazine.

Seems to me someone put out a 9mm in the good ol' days with such a magazine....

I may have missed it, but I don't recall the firearm having been specified as a long gun, just an assault weapon.

You sure could be right.I'd hope N.J. wouldn't call a .22 LR an "assault" weapon.

I just looked at some old .22 rifles we have around the house and the Marlin or Glenfield Model #60s are what I was thinking about.The older #60s we have take 17 rounds and the newer ones only take 15.

Those Model 60s are thick as fleas on a dogs back and I'd bet there are bunches of the older ones in use in N.J. that any normal person would never consider an "assault" weapon if that's the way the law reads.
