Well, Freepers it's going to be a looooooooooong day in the senate today, tonight, Thursday, and I'm guessing into Friday.

I figure we'll need a LIVE thread for this.

Looks like Tom Daschle is going to be speaking at 8:45am this morning followed by Frist at 9:11am

I don't know but he is one of the holdouts. I think he holds senate rules as sacred and above the current fray.

Well it makes the 'faithful' think that their representation is actually doing something up there. 30 whole hours? Too little, too late doesn't even come close to describing this lame PR stunt. Setting a time limit on a filibuster? Don't strain yourself guys

Technically your correct but I stand by my original. I'm talking real world. The GOP hasn't got the guts to go for it while the rats would do it without a majority. In the real world they changed the senate with one vote change to take control while the GOP refuse to do so unless they get 60.

Who ever heard of a filibuster where the side trying to get something passed was invited to speak? Generally the only people speaking during a filibuster are the opposition.

You are not correct. The number is not 51, but rather two-thirds of the members present and voting (and as such, the actual number changes depending on how large the quorum is).

This is also part of a Senate rule-- and the Supreme Court has held that rules passed by previous Senates are enforceable on a current Senate, since it is not a completely new body but rather an ongoing body.

At 10am,1pm,4pm eastern time, Radio Free Republic will be replaying the interview last night with Orrin Hatch who discusses the Justice For Judges Marathon at length the first 30 minutes.

Kay Daly, president of Coalition for a Fair Judiciary, and Chuck Muth, Citizens United (both regular Radio Free Republic show hosts) discuss the event.

However, there is one way the Republicans can ramrod these nominees in over the Democrats' objections, and it would only take 51 votes, but it would not involve a rule change.

Well now, that is an honorable, pricipaled position. However, when the other side openly flouts the traditions, possibly(I think they are) the intent of the Constitution, uses every deception they can think of, it is just naive.

A good supply of Pepto might be better. This is going to be a sickening affair. Don't look for the Pubbies to come out of this smelling like roses. This will end up going against the Pubbies, not the Dems. Remember when the Pubs shut down the gov during the Clinton Admin and it bit them (the Pubbies) in the rear. This will end up (snicker) biting the Pubbies in the rear, also.

Good question so there might be something more to this than we imagine. What if the GOP studied the undecideds and the rat base ? What if they presented both arguments to them without the media filters and found that they won the arguments on merit ? If so, then it would make sense.

This is my understanding. I am going to check it out today by calling my senator.

Effectively a simply majority. The minority has put its own construction on the rule If the President is asked for a ruling on whether Rule 22 may be applied to nominations and is sustained by a majority, then that becomes the precedent and override the minority claim. So it boils down to interpretation of the rule which remains formally unchanged.

We are in agreement. There is a real and a technically possible world.

I think there are actually 3 positions.... 60 votes to get cloture, 67 votes to change the rules and 51 for the so called "nuclear option"
