Why are the governor's lawyers trying to move this lawsuit to Tallahassee?

Possible reasons:

1. They are just postponing the inevitable by using delaying tactics. They know they will lose their case and are trying to buy a few more days before Terri's tube is removed again.

2. They think that Tallahassee judges will be more amenable to hear the governor's case.

3. Even if they lose in Tallahassee, the case will go to the First District Court of Appeals, not the Second District Court of Appeals. They might consider the First District Court of Appeals as friendlier to the governor.

For how long will this delay tactic work?

Possible outcomes:

1. The plaintiff's attorney, Felos, may ask Judge Baird to lift the stay. The case was automatically stayed when the governor's attorneys apppealed the motions' rulings. Baird can lift the stay immediately.

2. Baird may decide to wait until the motions' rulings are resolved at the appeals court and possibly the Florida Supreme Court. Judging by the previous history on this case, it will take at least a week for the motions' appeal to move through the highest courts.

Reporters continue to get the facts wrong.

Terri was not and is not suffering from "heart failure," in the sense in which this term is most commonly used:

Heart failure: The inability of the heart to pump blood at an adequate rate, resulting in congestion in the lungs, shortness of breath, edema in the lower extremities, and enlargement of the liver.

Terri's heart stopped for several minutes. The cause has not been adequately explained. But she she did not have "heart failure."

This is the same line of crap that leftist liberals spout when confronted by debate over moral issues...They think that they have the insight to decide other people's rights. Only Terri herself has the right to ask for her rights and absent her ability to do so, then state has the moral legal ethical obligation to protect her from murder.

This is the first article I've seen that explained what Baird cited as a "why" for spurning Jeb's claims of improper service and home court privilege. So it's being claimed that his having showed up in court in connection with the suit is tantamount to having been properly served, and that when a state government "takes action" against a citizen it may be challenged in that citizen's jurisdiction.

While sounding plausible on the surface, I'm still not sure whether this is ultimately "legal" or whether Baird has winged it a la FLangaroos. Bush's counsel, however, would be remiss not to try. If there is an "ulterior motive," it's not delay (as if Terri were hopping up and down screaming to die and the world would come to an end if it didn't happen within days) -- but to try to get the whole issue into a friendlier (more conservative) court in Leon County. This matters with respect to fact finding.
