The lawsuit, reiterating charges that first surfaced in a criminal case against three Burger King employees, alleges that restaurant workers may have been tampering with food for eight months before the contamination came to light.

Those turnpike consession franchaises are subject to hiring disadvantaged workers like prison releases, welfare to work folk, halfway houses, etc.... It's in the contract with the state. Those ones on the Atlantic City Expressway are so scary I won't even drink from the water fountain. The one's staffing a Starbucks were so bad they actually would give you a dose of mouth because they had no understanding of coffee ordering jargon, aksin you...."I don't know what's dis 4hit is and you's jist gonna have to slows down while I gits da manager(who had to do all the work). I and many others just walked out, which was fine with me and the hostile employee.

Great Post Here is a true story. I used to drive long distance rigs. In Montana we pulled into a small truck stop. My partner ordered a hamburger and I ordered a hot dog. The waitress was something else. About 220 with a sleeveless t-shirt on.

She walked over to an old freezer, got out a hamburger pattie, put it under her arm, and walked over to the grill.

My partner said, what are you doing with that pattie. She said "thawing it out".

I said "cancel my hotdog"

I can go one nastier. When I was in high school (late 1970's), I worked at McDonalds. One of my psycho co-workers was cleaning the bathroom and removed a used tampon from the ladies room and dropped it into a fry vat. After ensuring it was thoroughly "cooked", he removed it and placed it on the manager's desk.

The manager promptly made him remove all of the fry grease (which had just been changed), and thoroughly disinfect the fry vat. He was then fired the next day.

How could they tell?

It doesn't matter.
I just wonder if the contamination occured before or after cooking.

With today's level of DNA analysis, it should be a piece of cake to separate the perp's DNA from the cow's.
Fortunately, there is no need to separate IQs.

As for the punishment?
I don't think 10 years minimum mandatory is out of line...

What I can never understand in these cases is how the company is liable.

It's quite simple, really.

Unless Burger King knew about it and did not stop it, then how are they resposnsible.

It's the Master/Servant rule from Common Law in England, now the theory of Respondeat Superior where, if your employee does something wrong, the employer is responsible. This is a generalization, of course. This case has more, which has led to claims of negligent hiring, lack of supervision, duty (by Burger King) to the consumer to provide an untainted product..

These are criminal offenses worthy of jail time. I hope all of these people are prosecuted to the full extent. Then they can spend their jail sentences worrying about what's in their food.
