Well, I think it is a reference to whether the rape was conducted by threat of additional violence (i.e., at gunpoint) or was conducted by actual use of additional violence.

Don't get me wrong, all rape is inherently brutal. But when they say 'brutally raped' I tend to think of it as rape PLUS a vicious beating.

Don't apologize. We all handle tragedy differently, particularly death. The most horrible sight I saw, like yourself, were those poor folks jumping out of the towers. I don't ever want to see that again, ever, and I try to divert my thoughts to something else when I am reminded of it. Luckily, people around me don’t talk about it. They must feel the same way.

I think you're on to a new defense lawyer tactic here, although it closely resembles some tactics used in the past. For example, it is well known that you can try a similar defense by altering the above statement to replace the word "him" with "Twinkies".
