Judge Lets Parents Challenge Custody of Terri Schiavo

CLEARWATER, Fla. (AP) - A state circuit judge Wednesday refused to block an effort by the parents of a brain-damage woman to try to get her husband removed as her legal guardian. Attorneys for Michael Schiavo now have to respond in court to charges in the petition that he withheld proper care and therapy from his wife, Terri Schiavo, and that he has a conflict of interest because he's in a romantic relationship with another woman.
Bob and Mary Schindler, parents of Terri Schiavo, asked Circuit Judge George W. Greer to appoint Terri's brother or sister as guardian instead.
Schiavo had asked for the Schindler's request to be dismissed, but Greer refused.
In the past, Greer has repeatedly affirmed Michael Schiavo's legal right to remove Terri Schiavo's feeding tube and allow her to die, as he says she would have wished.
The guardianship issue is a sidebar to what is likely to be a major legal battle over a hastily passed state law that let Gov. Jeb Bush order the reinsertion of Terri Schiavo's feeding tube Oct. 21.
Michael Schiavo's attorney, with backing by the American Civil Liberties Union, has challenged the constitutionality of the law.

I am really tired of this whole Terri soap opera. I can't decide who is worse - the family or the husband. I think they should all grow up and settle their differences outside the courtroom.
By the way, who is paying all these legal fees and what axe do they have to grind.

You really ought to inform yourself. There are voluminous threads that detail everything you could ever want to know about this case, who is paying what, who got paid what, and so on. Otherwise your opinion is based on thin air. Just read the Terri threads for a couple of hours, and you will be more informed than the vast majority of people who get their "news" from Teev.

When you can't find the motive, look for the money. Michael Schiavo undoubtedly has a pricey life insurance policy, but "that darn wife" just won't die. Why else would he be so upset about her living? If she really is "brain dead", she wouldn't care about her body being kept alive. How could she "care" about anything, if her brain truly is "dead"?
He could walk away from all this in exchange for severing his financial resposibility for her. Her parents would certainly agree to that and donations would pour in from accross the country to pay her hospital bills......but that darn life insurance lottery pay-off he's waiting for would just go uncollected, wouldn't it?

I think Greer now has to acknowledge all the factors involved. This never was just a case of letting Terri die. There's collusion, distortion and general neglect of the facts and the conduct of Michael Schiavo which has been suspect from the beginning.

As to who's paying???...Terri is paying to have herself killed and the parents aren't charging you, so why should you care?

Great news! As long as the Schindler's petition for removal is pending, Terri's feeding tube may not be removed. I hope I'm not wrong.

This is awesome news!
Wouldn't it be fantastic after all these years they finally can take care of Terri.
I can't remember if it was Terri's brother or Mr. Schindler say on one program that there are doctors that have actually offered rehab services for free if they could ever get Terri.

Fortunately for Terri and her family, it really doesn't matter what you think. Enough people got tired of the Elian Gonalez story to allow him to be deported. The only way to settle this out of court would be for the parents to let the husband have his way.
