TROY | A 20-year-old man burglarizing an apartment pried open a tackle box and found nude photos of young girls, including his little sister.
The man turned himself and the pictures into police, who later arrested the apartment's tenant, a registered sex offender now facing a possible life sentence after being charged with rape of a child under the age of 13 and illegal use of a minor in nudity-oriented material.
Police said the rape charge against Richard Yearsley, 51, involved sexual touching in March of a child who was just under 4.
The 20-year-old man told police he watched Yearsley, whom he knew, leave the apartment and broke in once he left. Police said he then became enraged when he saw his 4-year-old sister's picture among "numerous" Polaroid photos of nude or partially nude young girls inside the tackle box.
He showed some of the photos to the building maintenance man, who convinced him to go to the police.
Police then searched the apartment late Friday and found photos of other young children in various states of dress.
The man said he knew what he had done was wrong, but "he knew that Yearsley was involved in something much worse and had to be stopped," according to the police report.
Police said that Yearsley admitted to taking photos of four other children during the past couple of years, and sexually touching some of them.
Wayne Willcox, deputy Piqua police chief, said the 20-year-old's case was referred to the city prosecutor to determine what charges will be filed.
Yearsley was registered as a sexually oriented offender with the Miami County Sheriff's Office following a 1995 conviction in Miami County for felony gross sexual imposition and disseminating matter harmful to juveniles.
Bail for Yearsley was set at $150,000 at arraignment Monday in Miami County Municipal Court.
Yearsley's preliminary hearing is scheduled for next Tuesday .
The Dayton Daily News is not identifying the 20-year-old man in order to protect the identity of his sister.
In addition, he will have to admit that he broke in, and that raises doubt as to whether the pics were found, or were planted...
Yeah, but those photos are bound to have the molester's greasy fingerprints all over them. Also, if they prosecute the burglar, the jury might just give him a pass.
If they "cut him a sweet deal", then he's working for the State.
No, as long as the state had no prior knowledge that he was going to enter the apartment, he's not the state's agent. Criminals provide evidence against other criminals all the time. They don't have to have known each other.
Hopefully, nothing worse than probation.
It would seem revenge is his motive.
How do you know justice isn't his motive? After all, he did expose himself to prosecution by turning over the pictures.
No, he's a hero because he turned himself, risking a jail term, for a greater good when he didn't have to.
Not true, even if he was after evidence, it's admissable. The bill of rights restricts the state, not the people.

I can only presume he was thumbing through the "numerous" pics enjoying them until he came upon that paticular picture. While I might be wrong (and would be glad to be wrong), I am strictly basing my opinion on what is printed in this article since I have no other sources.

If he is a hero then he must be a sandwitch. He comes as close to fitting that definition of hero as he does any of the others. Or we could add another definition for hero to the list:

If I were going to add a definition to the dictionary I would say that a hero is someone who sacrifices himself for a greater good.
There is a lot of legal precedent for letting him off easy. Criminals get charges reduced all the time for testifing against other criminals. And remember, he wasn't caught, he turned himself in.

Being enraged does not mean your motive is revenge. People see crimes every day and probably become enraged before they call the police -- which is what this guy did. If he was out for revenge he wouldn't have put himself in legal jeopardy. He could have done any number of terrible things after having access to the man's apartment -- and his refrigerator.
And there is no evidence to make any presumptions about the burglar being a pedophile himself.
Ah yes, but...........how in God's name would a judge know if the cops had prior knowledge? Should the judge simply take the state's (cop's) word for it? Cutting the burglar a "sweet deal" is evidence enough that "something stinks in Omaha". In any event, if a judge simply allows the evidence without asking the cops and prosecuters some really tough questions, it won't be long before cops recruit an army of "burglars with scruples" to circumvent that whole "search warrant fourth ammendment thingy". The best way for the judge to make sure that there is no monkey bussiness going on is to require that the burglar be prosecuted to the fullest extent of the law, or dismiss all evidence collected because of the burglary. Heh, the burglar broke the law, too. Breaking and entering is a FELONY.
Be honest. How would you like the cops to send an army of burglars (who have been given immunity from prosecution) to break into your house, because the cops have a hunch that you may own a gun, have politically incorrect literature, etc.? How would you like the cops to send a "burglar" to break into your home, plant drugs, "find" those drugs, report the "findings" to the cops, have you arrested, seize your home under confiscation laws for drug trafficing, then you get to watch their hero (the "burglar") collect his cash reward and walk free to break into another home, while you lose everything including your freedom? In the meantime, the cops get to keep your property. All this, because a so-called burglar "found religion while breaking into your house and simply had to tell the cops about you." Yeah, right. Sure he did. That may sound cynical, but that exact crap has been going on for years. Read "LOST RIGHTS" (I forget the author's name).
"Law and Order" Republicans had better be careful what they wish for. One day the "criminal" getting his ass kicked may be that same law abiding, but naive Republican.
A few final thoughts: it is believed that Anne Frank's family was turned in to the Gestapo by a burglar who got caught and was out to save his own ass. Kinda gives me the creeps about burglars talking to cops about the interesting things they've encountered while violating the rights of others. Yes, the kiddie porn creep should be prosecuted, but so should the burglar. Anything less is an injustice.
