PUBLIC STATEMENT OF THE SCHINDLER FAMILY IN RESPONSE TO THE
STATEMENT OF MICHAEL SCHIAVO
We, the Schindler family, wish to respond to the statement of Michael
Schiavo published by the media on October 20, 2003. Mr. Schiavo's
statement is an exercise in self-justification that completely rewrites
the true history of his efforts to have our Terri put to death by
starvation and dehydration.
Here are the facts that Mr. Schiavo has hidden in his statement:
- Terri, on Mr. Schiavo's orders, has had no therapy of any kind since
the Fall of 1991.
- At a medical malpractice trial in November 1992, Mr. Schiavo swore to
the jury that he would devote any jury award to Terri's care and
rehabilitation and he promised under oath that he would take care of
Terri for the rest of his life.
- After securing an award of over $700,000 for Terri's care, Mr. Schiavo
did an about-face, and has spent the last 10 years in a determined
campaign to cause Terri's death.
- This campaign began within a few months of the malpractice award, when,
in mid-1993, Mr. Schiavo had a "do not resuscitate" order placed in
Terri's medical chart.
- In June of 1993 Mr. Schiavo refused to allow treatment of an infection
Terri had developed, later admitting under oath that he expected the
infection to progress to a fatal sepsis that would kill Terri.
- In 1995, contrary to his promises to the jury that he would honor his
marriage vows, Mr. Schiavo, who still pretends to be Terri's "loving"
and "grieving" husband, began living with another woman, by whom he has
conceived two children out-of-wedlock. He calls this woman his fiancée,
even while his wife Terri lays starving and dehydrating to death in
hospice for the terminally ill-to which he consigned her three years
ago so that she would receive no therapy.
- It was not until 1998, when Mr. Schiavo hired Mr. Felos, that Mr.
Schiavo suddenly "remembered" that Terri had made some vague remarks
about not wanting to be sustained on anything "artificial" if she
became incapacitated.
- When he promised the malpractice jury back in 1993 that he would take
care of Terri for the rest of his life, Mr. Schiavo said nothing to the
jury about Terri not wanting to be sustained on anything "artificial."

- Mr. Schiavo's crocodile tears and his statement that "I struggle with"
the Court's order to starve and dehydrate Terri defy belief. That order
is the end result of Mr. Schiavo's utter determination to see Terri
dead so that he can marry his "fiancée."
- Even though he has no Court order authorizing his actions, Mr. Schiavo
has not only removed the feeding tube that has sustained our Terri for
13 years, but has also ordered that no attempt be made to feed Terri by
mouth, even if she could be trained to take sustenance orally.
- On Saturday, October 18, 2003, one of Mr. Schiavo's team of lawyers
refused to allow our Terri to receive her final Holy Communion. This
lawyer would not even allow Msgr. Malanowski to place a miniscule piece
of the Host on her tongue. Perhaps Michael fears that if Terri can
swallow a piece of the Host, the whole world will know he is starving a
helpless woman who can take sustenance by mouth.
- Mr. Schiavo has spent the great bulk of Terri's malpractice award on
legal fees for Mr. Felos, in an effort to have Terri killed. He spent
nothing on Terri's therapy and rehabilitation-contrary to the promises
he made to the jury, under oath, more than ten years ago.
We cannot allow Mr. Schiavo's lies to go unanswered. We pray that God
will see to it that justice is done and that our Terri's life is
delivered from the clutches of this ruthless man, who dares to pretend
that he is grieving with us over what he has done to Terri.

Many years ago, two women came before the Great King Solomon in the bible, and each woman claimed that the child in question was theirs, and wanted guardianship over it.
King Solomon said to just cut the baby in half, and to give each woman half of the baby.
But the real mother cried out, "Oh, do not kill the baby, just give it to the other mother", for she did not want to see her child dead, regardless of her loss. Of course, Solomon knew who was the real mother, and he gave the baby to her. No real mother would want their child to die!
That was just a few thousand years ago, and today we see the case of Terri Schiavo come before the courts here in the USA. To the court comes a man who claims to be Terri's husband. He has been wanting Terri to die for the longest time, and he lives in adulterous relationship with another woman, and has a child by her, and even another unborn. Michael Schiavo long ago stopped loving Terri. He claims to want what is best for his wife, and he calls it "death".
The real parents have petitioned for guardianship of Terri, but the courts have failed to recognize their position, which is simply one of love of a real parent for their child. This is something that is God-given.
Those in our courts are not as wise as King Solomon, and they have not allowed the real love to come to play in this case. Terri has been denied rehabiltation, even though she won a law suit that should have adquately provided her a chance to improve her life. Terri is now on medicare, with Michale leaving Terri as a burden to the state, while this so called "husband" has seemingly squandered almost all of the funds trying to kill her legally. Very little money is left.
I ask God in heaven to please provide us someone in the courts with the wisdom of King Solomon who cares about life and love. It is my greatest hope that in this case that life and love will prevail. I ask God to not allow evil and death to reign in our courts and in the life of Terri Schiavo, for we will all suffer for this.
Once I was comotose, and the doctor said that I would not live, but I did, and here I am. It was the patient love of my mother that pulled me through, and even when I could not talk, I knew her voice and trusted it. My doctor said that my mother was taking better care of me than any hospital ever could, and he allowed me to stay at home. May God be with Terri and her parents, and guide and protect them from all harm and the evil that surrounds them. May they be delivered from it.

I despise the ACLU. However, I have no idea, from your post, what the ACLU is doing. These posts are generally a rehash of the same accusations without any explanation. As a result, I am uninformed and frustrated.
I have said in the past, and I repeat, that this is appears to be an easy case. A feeding tube should not be removed from a woman who is severely disabled. That is clearly immoral
However, I don't think that is the issue that some are concerned about. Hence, people are speaking past each other on this case.
The other issue is this: in the absence of a living will or directive to a physician, does a parent of a minor child or a spouse have authority to direct the medical care of their children or their spouse.
One may not like it, but MS is Terri's husband. Marriage conveys to a spouse certain rights and authority. As a husband, I can give a physician consent to operate on my wife. You may not approve of everything a parent does, but that parent can give consent for his minor children.
Terri Schiavo's parents cannot give informed consent for their daughter. They lost that right and authority when she married her adulterous husband.
The question is when do we lay aside the rights and authority given to spouses and children? Can I give a directive, in the absence of a living will, indicating that my wife does not desire a ventilator or a feeding tube without being labeled a murderer? Can I refuse some extraordinary treatment for my children without being labeled a wacko?
I may be wrong, but it seems to me we have two competing interests here. A person's right to live and that rights of that person's spouse, parent or guardian to make medical condition for the person under their care. If we suggest that the person's right to life always rules, then nothing could ever be done to remove any life sustaining treatment be that a feeding tube, a ventilator or a heart/lung machine. If we suggest that a person with authority always calls the shots, then a parent or spouse could withhold the most simple treatment that could save life.
Where do conservatives want to draw the line? If we are naturally suspicious of government intervention, how much power do we give to the state to intervene in these matters? Do we want the state substituting its judgment for the judgment of a parent or guardian.
I understand the situation with Terri Schiavo. I am looking down the road at other cases and think we should understand the precedents we set and stake out a consistent ethical framework, understanding what could be a conflict between a person's right to life and a parent or spouse's authority to direct another's care.

However, it seems to be more complicated than what you suggest. As I mentioned in my post, the law recognizes that my marriage bond to my wife is more controlling than her bond to her parents. When she married me, she left them and has cleaved unto me. As a result, they have lost whatever authority they had over her.
MS may be a demon and Terri's parents may truly love her, but MS is Terri's husband. How do you terminate his spousal rights and put her back under the authority of her parents?
That's another component of the legal problem that the court is faced with here. In a way it would be simple if it were merely a matter of life and love.

BEFORE ME the undersigned authority personally appeared CARLA SAUER IYER, R.N., who being first duly sworn, deposes and says:
1. My name is Carla Sauer Iyer. I am over the age of eighteen and make this statement of my own personal knowledge.
2. I am a registered nurse in the State of Florida, having been licensed continuously in Florida from 1997 to the present. Prior to that I was a Licensed Practical Nurse for about four years.
3. I was employed at Palm Garden of Largo Convalescent Center in Largo, Florida from April 1995 to July 1996, while Terri Schiavo was a patient there.
4. It was clear to me at Palm Gardens that all decisions regarding Terri Schiavo were made by Michael Schiavo, with no allowance made for any discussion, debate or normal professional judgment. My initial training there consisted solely of the instruction "Do what Michael Schiavo tells you or you will be terminated." This struck me as extremely odd.

5. I was very disturbed by the decision making protocol, as no allowance whatsoever was made for professional responsibility. The atmosphere throughout the facility was dominated by Mr. Schiavo's intimidation. Everyone there, with the exception of several people who seemed to be close to Michael, was intimidated by him. Michael Schiavo always had an overbearing attitude, yelling numerous times such things as "This is my order and you're going to follow it." He is very large and uses menacing body language, such as standing too close to you, getting right in your face and practically shouting.
6. To the best of my recollection, rehabilitation had been ordered for Terri, but I never saw any being done or had any reason at all to believe that there was ever any rehab of Terri done at Palm Gardens while I was there. I became concerned because Michael wanted nothing done for Terri at all, no antibiotics, no tests, no range of motion therapy, no stimulation, no nothing. Michael said again and again that Terri should NOT get any rehab, that there should be no range of motion whatsoever, or anything else. I and a CNA named Roxy would give Terri range of motion anyway. One time I put a wash cloth in Terri's hand to keep her fingers from curling together,

and Michael saw it and made me take it out, saying that was therapy.
7. Terri's medical condition was systematically distorted and misrepresented by Michael. When I worked with her, she was alert and oriented. Terri spoke on a regular basis while in my presence, saying such things as "mommy," and "help me." "Help me" was, in fact, one of her most frequent utterances. I heard her say it hundreds of times. Terri would try to say the word "pain" when she was in discomfort, but it came out more like "pay." She didn't say the "n" sound very well. During her menses she would indicate her discomfort by saying "pay" and moving her arms toward her lower abdominal area. Other ways that she would indicate that she was in pain included pursing her lips, grimacing, thrashing in bed, curling her toes or moving her legs around. She would let you know when she had a bowel movement by flipping up the covers and pulling on her diaper and scooted in bed on her bottom.
8. When I came into her room and said "Hi, Terri", she would always recognize my voice and her name, and would turn her head all the way toward me, saying "Haaaiiiii" sort of, as she did. I recognized this as a "hi", which is very close to what it sounded like, the whole sound

being only a second or two long. When I told her humrous stories about my life or something I read in the paper, Terri would chuckle, sometimes more a giggle or laugh. She would move her whole body, upper and lower. Her legs would sometimes be off the bed, and need to be repositioned. I made numerous entries into the nursing notes in her chart, stating verbatim what she said and her various behaviors, but by my next on-duty shift, the notes would be deleted from her chart. Every time I made a positive entry about any responsiveness of Terri's, someone would remove it after my shift ended. Michael always demanded to see her chart as soon as he arrived, and would take it in her room with him. I documented Terri's rehab potential well, writing whole pages about Terri's responsiveness, but they would always be deleted by the next time I saw her chart. The reason I wrote so much was that everybody else seemed to be afraid to make positive entries for fear of their jobs, but I felt very strongly that a nurses job was to accurately record everything we see and hear that bears on a patients condition and their family. I upheld the Nurses Practice Act, and if it cost me my job, I was willing to accept that. 9. Throughout my time at Palm Gardens, Michael Schiavo was focused

on Terri's death. Michael would say "When is she going to die?," "Has she died yet?" and "When is that bitch gonna die?" These statements were common knowledge at Palm Gardens, as he would make them casually in passing, without regard even for who he was talking to, as long as it was a staff member. Other statements which I recall him making include "Can't anything be done to accelerate her death - won't she ever die?" When she wouldn't die, Michael would be furious. Michael was also adamant that the family should not be given information. He made numerous statements such as "Make sure the parents aren't contacted." I recorded Michael's statements word for word in Terri's chart, but these entries were also deleted after the end of my shift. Standing orders were that the family wasn't to be contacted, in fact, there was a large sign in the front of her chart that said under no circumstances was her family to be called, call Michael immediately, but I would call them, anyway, because I thought they should know about their daughter.
10. Any time Terri would be sick, like with a UTI or fluid buildup in her lungs, colds, or pneumonia, Michael would be visibly excited, thrilled even, hoping that she would die. He would say something like,

"Hallelujah! You've made my day!" He would call me, as I was the nurse supervisor on the floor, and ask for every little detail about her temperature, blood pressure, etc., and would call back frequently asking if she was dead yet. He would blurt out "I'm going to be rich!" and would talk about all the things he would buy when Terri died, which included a new car, a new boat, and going to Europe, among other things.
11. When Michael visited Terri, he always came alone and always had the door closed and locked while he was with Terri. He would typically be there about twenty minutes or so. When he left Terri would be trembling, crying hysterically, and would be very pale and have cold sweats. It looked to me like Terri was having a hypoglycemic reaction, so I'd check her blood sugar. The glucometer reading would be so low it was below the range where it would register an actual number reading. I would put dextrose in Terri's mouth to counteract it. This happened about five times on my shift, as I recall. Normally Terri's blood sugar levels were very stable due to the uniformity of her diet through tube feeding. It is medically possible that Michael injected Terri with Regular insulin, which is very fast acting, but I don't have

any way of knowing for sure.
12. The longer I was employed at Palm Gardens the more concerned I became about patient care, both relating to Terri Schiavo, for the reasons I've said, and other patients, too. There was an LPN named Carolyn Adams, known as "Andy" Adams who was a particular concern. An unusual number of patients seemed to die on her shift, but she was completely unconcerned, making statements such as "They are old - let them die." I couldn't believe her attitude or the fact that it didn't seem to attract any attention. She made many comments about Terri being a waste of money, that she should die. She said it was costing Michael a lot of money to keep her alive, and that he complained about it constantly (I heard him complain about it all the time, too.) Both Michael and Adams said that she would be worth more to him if she were dead. I ultimately called the police relative to this situation, and was terminated the next day. Other reasons were cited, but I was convinced it was because of my "rocking the boat."
13. Ms. Adams was one of the people who did not seem to be intimidated by Michael. In fact, they seemed to be very close, and Adams would do whatever Michael told her. Michael sometimes called Adams at

Front line Terri supporters in Florida are urging us to contact the ACLU with the facts in Terri's case.
I dont think the aclu cares about the facts (when have facts ever stopped the commie bastards from pursuing their agenda) they see this as a chance to go head to head with Jeb Bush. If Bush didnt get involved the aclu would probably never touched this case.
