There will STILL be the need for the legislation. This is narrow legislation, BUT it will not just apply to Terri. It will apply to any PVS patient whose s & d death is contested by other family. The Gov will have the authority to issue a "stay of execution" of sorts in these cases. Do you really think Terri is the only case like this?

Here is the text:

Governor/One-time Stay: authorizes Governor to issue one-time stay to prevent withholding of nutrition & hydration under certain circumstances; provides for expiration of stay; authorizes Governor to lift stay at any time; provides for revocation of stay; provides that person is not civilly liable & is not subject to regulatory or disciplinary sanctions for taking action in compliance with any such stay.


There are three amendments added by the senate apparently but they aren't available online yet.

This nothing but an attempt to take the political pressure off cowardly politicians. We'll take it, because it will save Terri. But it does nothing to solve anything beyond that. The death merchants will take their loss of this one battle with an evil grin, and go forward in the knowledge that they are winning the war.

I just called Senator Nelson's office and told the lady that I was not a resident but wanted my voice to be heard. She will keep a tally of non-resident calls. She told me that she was very upset that her tubes were removed, I think she was on the verge of tears. Makes me very glad I called. If you are not a resident, call anyway and tell them you want to your voice to be heard even if you aren't a resident.

817.505 Patient brokering prohibited; exceptions; penalties.--

(1) It is unlawful for any person, including any health care provider or health care facility, to:

(a) Offer or pay any commission, bonus, rebate, kickback, or bribe, directly or indirectly, in cash or in kind, or engage in any split-fee arrangement, in any form whatsoever, to induce the referral of patients or patronage from a health care provider or health care facility;

(b) Solicit or receive any commission, bonus, rebate, kickback, or bribe, directly or indirectly, in cash or in kind, or engage in any split-fee arrangement, in any form whatsoever, in return for referring patients or patronage to a health care provider or health care facility; or

(c) Aid, abet, advise, or otherwise participate in the conduct prohibited under paragraph (a) or paragraph (b).

(2) For the purposes of this section, the term:

(a) "Health care provider or health care facility" means any person or entity licensed, certified, or registered with the Agency for Health Care Administration; any person or entity that has contracted with the Agency for Health Care Administration to provide goods or services to Medicaid recipients as provided under s. 409.907; a county health department established under part I of chapter 154; any community service provider contracting with the Department of Children and Family Services to furnish alcohol, drug abuse, or mental health services under part IV of chapter 394; any substance abuse service provider licensed under chapter 397; or any federally supported primary care program such as a migrant or community health center authorized under ss. 329 and 330 of the United States Public Health Services Act.

(b) "Health care provider network entity" means a corporation, partnership, or limited liability company owned or operated by two or more health care providers and organized for the purpose of entering into agreements with health insurers, health care purchasing groups, or the Medicare or Medicaid program.

(c) "Health insurer" means any insurance company authorized to transact health insurance in the state, any insurance company authorized to transact health insurance or casualty insurance in the state that is offering a minimum premium plan or stop-loss coverage for any person or entity providing health care benefits, any self-insurance plan as defined in s. 624.031, any health maintenance organization authorized to transact business in the state pursuant to part I of chapter 641, any prepaid health clinic authorized to transact business in the state pursuant to part II of chapter 641, any prepaid limited health service organization authorized to transact business in this state pursuant to chapter 636, any multiple-employer welfare arrangement authorized to transact business in the state pursuant to ss. 624.436-624.45, or any fraternal benefit society providing health benefits to its members as authorized pursuant to chapter 632.......

"....Judge George Greer: Ruler of the Kangaroo Court set on killing Terri Schiavo. Impartial? Not in the least! Worked side by side as county commissioner with Barbara Sheen Todd (county commissioner) for eight YEARS. Barbara Sheen Todd is on the board of the hospice. Also, Judge Greer's fellow judge, Judge John Lenderman is the brother of Martha Lenderman (also on the hospice board! See the Hospice Board members! Greer accepted as the basis of his rulings, the questionable testimony of Michael Schiavo (and his family) that Terri would wish to be killed, yet Michael never stated that before he got about a Million Dollars to care for Terri forever. Greer also accepted as the basis of his rulings, the "opinion" of a third doctor who just happens to be the brother of a close associate of George Felos, right-to-kill attorney, and very significantly, former CHAIRMAN of the hospice board! If there ever was a rigged court, Judge Greer's is it!...."

I think a full-scale criminal investigation of Schiavo, Felos, Greer, $uncoast Hospice, Centzone (?) is in order. I also think there's is enough suspicion of wrong-doing in this case, for Terri to be fed NOW, and to be put in protective custody from Schiavo/Felos/Greer/$uncoast Hospice NOW. Anything less would make the State of Florida complicit. JUST my opinion, of course.

A bill to be entitled

2 An act relating to the authority for the

3 Governor to issue a one-time stay; authorizing

4 the Governor to issue a one-time stay to

5 prevent the withholding of nutrition and

6 hydration under certain circumstances;

7 providing for expiration of the stay;

8 authorizing the Governor to lift the stay at

9 any time; providing for revocation of the stay;

10 providing that a person is not civilly liable

11 and is not subject to regulatory or

12 disciplinary sanctions for taking an action in

13 compliance with any such stay; providing an

14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

17

18 Section 1. (1) The Governor shall have the authority

19 to issue a one-time stay to prevent the withholding of

20 nutrition and hydration from a patient if, as of October 15,

21 2003:

22 (a) That patient has no written advance directive;

23 (b) The court has found that patient to be in a

24 persistent vegetative state;

25 (c) That patient has had nutrition and hydration

26 withheld; and

27 (d) A member of that patient's family has challenged

28 the withholding of nutrition and hydration.

29 (2) The Governor's authority to issue the stay expires

30 15 days after the effective date of this act, and the

31 expiration of that authority does not impact the validity or

1 the effect of any stay issued pursuant to this act. The

2 Governor may lift the stay authorized under this act at any

3 time. The Governor may revoke the stay upon a finding that a

4 change in the condition of the patient warrants revocation. A

5 person may not be held civilly liable and is not subject to

6 regulatory or disciplinary sanctions for taking any action to

7 comply with a stay issued by the Governor pursuant to this

8 act.

I do not believe God causes delays.

God delays all the time. Remember the saying "God's delays are not God's denials"?

I don't mean that He would delay in order for Terry to suffer as much as possible - but so that the miracle would be so obvious that no one could deny it.

That is not how I read it at all. Also from the House site:

TALLAHASSEE – Speaker Johnnie Byrd announced the passage of legislation by a vote of 68-23 to help save Terri Schiavo. If passed by the Senate and signed by the Governor, the bill will allow the governor to issue a stay on court-ordered starvation and dehydration deaths under certain circumstances.

This all may be moot regarding Terri, since the stupid Senate added amendments, they'll have to reconcile bills which may take another stinkin' day. Grrrrr.

Here is the email I sent to the Florida senators...loosely the same as a post I made on another thread:

"Why are you waiting until tonight to address this bill? Are you HOPING Terri will die so that you can abdicate responsibility for the consequences of your decision, or indecision? Why isn't this the FIRST thing on the agenda??? TIME IS OF THE ESSENCE! While all you fat cats are sitting around indulging yourselves in your taxpayer funded buffets today, remember that there is a woman, the age of some of you, the age of some of your own daughters, who is lying in a bed starving and thirsty and in pain, and YOU have the power to feed her, and give her water and relieve her pain."
