The divorce idea appears to have potential.
This contention from Newsmax and AP doesn't hold water, I'm afraid:
According to the Associated Press, health workers charged with removing the feeding tube might have to choose between violating Greer's order or Florida law. Under Title 46, Chapter 825, Section 102 (3)(a) of the Florida Criminal Statutes, the crime of "neglect of an elderly person or disabled adult" occurs as the result of:
"A caregiver's failure or omission to provide an elderly person or disabled adult with the care, supervision and services necessary to maintain the elderly person's or disabled adult's physical and mental health, including, but not limited to, food, nutrition, clothing, shelter, supervision, medicine and medical services that a prudent person would consider essential for the well-being of the elderly person or disabled adult."
It's wishful thinking because Greer and Schiavo claim to have the stated wish of Terri to be allowed to die. The caregivers are in no jeopardy if they pull the plug.
That isn't to say that the caregiver community couldn't collectively and unanimously refuse to pull the plug or perhaps walk off the job one by one as they are ordered to do so--a long shot at this late hour, but another avenue to try.

Ok, let's start looking up the statutes for domestic violence in Florida! I'll start hunting and I'll post it here. Phenn, what do you think?
To: lakey
If domestic violence looked like it would stick, that might be the wedge to force Michael to agree to a divorce (we'll drop the DV charge if you agree to it, bubba).
To: litany_of_lies
Last I searched, if Florida Medicaid (hospice) receives any federal money and "pulls the plug," it is illegal. Doesn't matter what Florida's laws are.

Some of what Michael has done almost sounds like kidnapping. But, let's not get off the subject ;)

Here is a Florida statute on DV
http://www.flsenate.gov/Statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=Ch0741/SEC28.HTM&Title=-%3E2003-%3ECh0741-%3ESection%2028 741.28(2) "Domestic violence" means any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member. Sorry it is a long link.

That a$$! He is going to have her die alone? Her family must be just heartsick over all of this. That man does not deserve to live, but I believe his life will be a miserable one in the end. No piece of rot like him deserves to have peace in their life.

Last I searched, if Florida Medicaid (hospice) receives any federal money and "pulls the plug," it is illegal. Doesn't matter what Florida's laws are. That's a damned important point. I hope someone has a way to communicate with the Schindler defense team. They could get a restraining order on this basis, I would think.
To: dixiegrrl
Wait a minute--does he have a kid by his honey (open and shut case)? Even if he doesn't, a threat to charge him with this crime might be motivator to get him to agree to a divorce.

2 in fact! She is pregnant again by him!
To: dixie sass
I hear you dixie sass, and I'm sorry I snapped at you. We all [or most of us] feel the same way. Let's keep crying out to God. I know He's using this situation to get our attention. Is the whole world watching this? I read the touching letter from the people in the UK. Let's each of us look deep inside ourselves, confess our sins to God, ask His forgiveness, and ask him not to hold our sins against Terri. If we confess our sins He is graceful and just to forgive. He wants to do us good and not harm. He wants the whole world to turn back to Him. So let's pray even for Michael Schiavo and all with him who want to harm Terri. Let's pray that as God touched Saul on his way to Damascus, He will reach out and touch the hearts of Michael and George Felos and George Greer. Let's pray for Jeb Bush. Hey! Let's even pray that the Arabs and Israelis will stop hating each other! They are the key to peace in the Middle East. They are brothers, and they've been fighting for thousands of years. What has it wrought? God is bigger than all of us. He is capable of turning this world back to the Garden of Eden if we will all just stop hating each other. He wants to do it again. But He won't as long as we hate each other. Two things happened in the Garden of Eden. Man listened to Lucifer, and man hated his brother enough to kill him. Why do you suppose Jesus said the two greatest commandments were to love God with all your heart and soul, and to love your brother as yourself? Because that will put the world back in God's good graces. Let's pray that God will save Terri - He is capable! -and let's pray that He uses her to bring healing among all of us.

I found this in my search. It's not DV, but it is all aboutwhat the law doesn't want the court to allow Michael to do, and he's getting away with it anyway.
744.446 Conflicts of interest; prohibited activities; court approval; breach of fiduciary duty.--
(1) It is essential to the proper conduct and management of a guardianship that the guardian be independent and impartial. The fiduciary relationship which exists between the guardian and the ward may not be used for the private gain of the guardian other than the remuneration for fees and expenses provided by law. The guardian may not incur any obligation on behalf of the guardianship which conflicts with the proper discharge of the guardian's duties.
(2) Unless prior approval is obtained by court order, or unless such relationship existed prior to appointment of the guardian and is disclosed to the court in the petition for appointment of guardian, a guardian may not:
(a) Have any interest, financial or otherwise, direct or indirect, in any business transaction or activity with the guardianship;
(b) Acquire an ownership, possessory, security, or other pecuniary interest adverse to the ward;
(c) Be designated as a beneficiary on any life insurance policy, pension, or benefit plan of the ward unless such designation was validly made by the ward prior to adjudication of incapacity of the ward; and
(d) Directly or indirectly purchase, rent, lease, or sell any property or services from or to any business entity of which the guardian or the guardian's spouse or any of the guardian's lineal descendants, or collateral kindred, is an officer, partner, director, shareholder, or proprietor, or has any financial interest.
(3) Any activity prohibited by this section is voidable during the term of the guardianship or by the personal representative of the ward's estate, and the guardian is subject to removal and to imposition of personal liability through a proceeding for surcharge, in addition to any other remedies otherwise available.
(4) In the event of a breach by the guardian of the guardian's fiduciary duty, the court shall take those necessary actions to protect the ward and the ward's assets.

The punishment for open adultery appears to be 60 days in jail or less--A Pyrrrhic victory. If I were Michael, I'd play the martyr, rail against the pro-life fanatics, and have the plug pulled.
BUT, It looks like the law COULD put his honey in prison too, which might make him change his tune.
But, overall, ii would be nice to come up with something something stronger.

Also found this:
744.391 Actions by and against guardian or ward.--If an action is brought by the guardian against the ward, or vice versa, or if the interest of the guardian is adverse to that of his or her ward, a guardian ad litem shall be appointed to represent the ward in that particular litigation. In any litigation between the guardian and the ward, a guardian ad litem shall be appointed to represent the ward. If there is a conflict of interest between the guardian and the ward, the guardian ad litem shall petition the court for removal of the guardian. Judgments in favor of the ward shall become the property of the ward without the necessity for any assignment by the guardian or receipt by the ward upon termination of guardianship. The guardian may receive payment and satisfy any judgment in behalf of the ward without joinder by the ward.
History.--s. 1, ch. 74-106; s. 64, ch. 89-96; s. 1097, ch. 97-102.
Note.--Created from former s. 744.61.

It's illegal for Terri to be in a hospice anyway. She was not terminal, and she's been there too long anyway. Is that relevant or not? I think the Schindlers tried to make that point before and got nowhere. But maybe more exposure wouldn't hurt.
